E. Fish and Wildlife Conservation Areas; r ` <br /> F. Slopes of 25% or greater associated or in conjunction with <br /> one or more of the sensitive elements listed in subsections <br /> A through E of this Section; <br /> G. Groundwater discharge areas, such as springs and seeps, that <br /> are associated with or occur upon any of the <br /> environmentally sensitive areas listed in subsections A <br /> through F of this Section; and <br /> Section 5: Exemptions, Exceptions, Modifications. Certain <br /> activities are exempt from the requirements of this Ordinance, while <br /> other activities which are regulated by this Ordinance may be <br /> granted specific exceptions or an administrative modification as <br /> provided in this Ordinance. This Section lists the activities which <br /> are exempt from the regulations of this Ordinance, the exceptions <br /> which may be granted to the requirements of this Ordinance, and the <br /> administrative modifications which can be granted to other <br /> requirements of Title 19 of the Everett Municipal Code. <br /> A. Exemptions. All activities which are exempted, excepted, or <br /> granted modifications shall prevent, minimize and/or compensate <br /> for impacts to environmentally sensitive areas to the maximum <br /> extent possible. Such activities which are exempted, excepted, <br /> or granted modifications shall not be exempt from other laws or <br /> permit requirements which may be applicable. The following are <br /> exemptions to the provisions of this Ordinance; however, the <br /> exemptions listed herein may not be exempted from other State or <br /> Federal regulations or permit requirements: <br /> 1 . Emergencies that threaten the public health, safety and <br /> welfare, as verified by the City; <br /> 2 . Legally constructed structures in existence on the date this <br /> Ordinance becomes effective that do not meet the buffer <br /> requirements of this Ordinance may be remodelled, <br /> reconstructed or replaced provided that the new construction <br /> or related activity does not further encroach into an <br /> environmentally sensitive area. Remodelling or <br /> reconstruction shall be subject to all other requirements of <br /> the zoning code; <br /> 3 . Existing and ongoing agriculture in agricultural zones in <br /> existence as of the date this Ordinance becomes effective; <br /> provided, however, at such time as the property ceases to be <br /> used for agricultural activities, the property shall be <br /> brought into compliance with the provisions of this <br /> Ordinance; <br /> 4 . Normal and routine maintenance of legally constructed <br /> irrigation and drainage ditches, provided that this <br /> exemption shall not apply to any ditches used by salmonids; <br /> 5. Normal and routine maintenance of agricultural ponds, <br /> livestock watering ponds and fish ponds, provided that such <br /> activities shall not involve the conversion of any wetland <br /> or stream not used for such purposes on the date this <br /> A <br />
