Studies by the qualified experts <br /> shall be submitted to determine the conditions which were likely <br /> to exist on the lot prior to the illegal alteration. <br /> E. Restoration shall also include installation and maintenance of <br /> interim and emergency erosion controls measures until such time <br /> as the restored ground cover and vegetation reach sufficient <br /> maturation to function in compliance with the performance <br /> standards adopted by the City. <br /> F. The City shall stop work on any existing permits and halt the <br /> issuance of any or all future permits or approvals for any <br /> activity which violates the provisions of this Ordinance until <br /> the property is fully restored in compliance with this Ordinance <br /> and all penalties are paid. <br /> G. Notwithstanding the other provisions provided in this Ordinance, <br /> anything done contrary to the provisions of this Ordinance or the <br /> failure to comply with the provisions of this Ordinance shall be <br /> and the same is hereby declared to be a public nuisance. <br /> The City is hereby authorized to apply to any court of competent <br /> jurisdiction for any such court, upon hearing and for cause shown, <br /> may grant a preliminary, temporary or permanent injunction <br /> restraining any person, firm, and/or corporation from violating any <br /> of the provisions of this Ordinance and compelling compliance with <br /> the provisions thereof. The violator shall comply with the <br /> injunction and pay all costs incurred by the City in seeking the <br /> injunction. <br /> Section 25: Section 39.130.0 of Ordinance 1671-89, which reads: <br /> C. Minimum Lot Area: Averaging in Subdivisions. In any formal <br /> subdivision or short subdivision, the individual lots of the <br /> subdivision shall be considered legal lots if the average of the <br /> areas of all lots in the subdivision meets the minimum requirement <br /> for the district in which the subdivision is located, provided: <br /> 1. That no individual lot therein shall have less than ninety <br /> (90) percent of the minimum lot area required in the zone in <br /> which the lot is located; <br /> 2. A reduction of five percent in the required lot width may be <br /> applied to 20 percent of the lots of a plat provided no <br /> reduction in the required area is applied to these lots. <br /> 3 . The average net area for all lots in the plat shall not be <br /> less than the minimum net area requirement for the zone in <br /> which the plat is located. <br /> 4.
