C. Minimum Lot Area: Averaging in Subdivisions. In any formal <br /> subdivision or short subdivision, the individual lots of the <br /> subdivision shall be considered legal lots if the average of the <br /> areas of all lots in the subdivision meets the minimum requirement <br /> for the district in which the subdivision is located, provided: <br /> 1. That no individual lot therein shall be less than <br /> five-thousand (5,000) square feet in area or fifty (50) feet <br /> in width; <br /> 2 . Not more than a twenty-five percent increase over the <br /> required minimum lot area for any single lot shall be <br /> credited in computing average lot area; <br /> 3 . The average net area for all lots in the subdivision shall <br /> not be less than the minimum net area requirement for the <br /> zone in which the subdivision is located. <br /> 4. Common open space and/or common recreation areas provided <br /> within a subdivision shall be permitted to be included in <br /> the calculation of average lot area. <br /> Section 26: Subsection 42.100 of Ordinance 1671-89, which reads: <br /> A. Administrative Review - No Hearing Required. <br /> 1. Uses requiring approval using Process II.A shall be reviewed <br /> by the Planning Director. <br /> 2 . The review process shall not begin until a application which <br /> has been determined to be complete by the Planning Director, <br /> has been submitted along with filing fees, when required. <br /> 3 . All decision made by the Planning Director shall be issued <br /> in writing. The Planning Director may attach to any permit <br /> approval such conditions as may be necessary to assure <br /> compliance with this Ordinance or any other regulations <br /> administered by federal, state or city agencies. <br /> 4 . Public notification is not required for decision made using <br /> Process II .A. <br /> B. Waived Hearing - Adjoining Property Owners Notified of Decision. <br /> Uses requiring Review Process II.B shall be reviewed using the <br /> following procedure: <br /> 1 . The Planning Director makes a written decision to approve, <br /> disapprove, or approve with conditions the use proposed by <br /> the applicant. The written decision shall contain a list of <br /> Findings and Conclusions supporting the decision of the <br /> Planning Director. <br /> 2. Owners of properties located within 300 feet of the <br /> boundaries of the subject lot(s) are notified of the <br /> Planning Director's decision and the procedures for <br /> requesting a hearing. <br /> 34 <br />
