7 <br /> INTERLO CAL STORMWATER AGREEMENT <br /> This Interlocal Stormwater Agreement(this "Agreement") is entered into as of <br /> May _, 2011, by and between the CITY OF EVERETT, a Washington municipal <br /> corporation(the"City"), and PUBLIC UTILITY DISTRICT NO. 1 OF SNOHOMISH <br /> COUNTY, WASHINGTON, a municipal corporation of the State of Washington(the <br /> "District"). <br /> RECITALS <br /> A. The District owns property located at 1707 Scenic Drive,Everett, WA. <br /> 98203 (the "District Property"). The District is preparing to construct improvements on <br /> the District Property. The legal description of the District Property is: <br /> Lot 5, Block 3,Plat of Beverly Park, according to the Plat thereof recorded <br /> in Volume 8 of Plats,page 24, records of Snohomish County, Washington; <br /> and <br /> Lot 3 of City of Everett Short Plat recorded under Snohomish County <br /> Auditor's 90110120078,being a portion of the southeast quarter of <br /> Section 7, Township 28 North, Range 5 East, W. M., and Lots 1 through <br /> 4, Block 3, Plat of Beverly Park, according to the Plat thereof recorded in <br /> Volume 8 of Plats,page 24,records of Snohomish County, Washington. <br /> Tax Parcel Nos. : 00 3939 003 005 00 <br /> 28 0507 001 042 00 <br /> B. In connection with this planned construction,the District has applied to <br /> the City for Public Works Permit No. PW0911-007 (the"Permit"). <br /> C. As of the date of this Agreement, some of the stormwater originating from <br /> Grant Drive, Scenic Drive and from other areas is piped onto the District Property, and <br /> then infiltrates into the ground. In connection with the planned improvements on the <br /> District Property,the District intends to re-route the pipes that convey this stormwater, <br /> such that low flows will infiltrate into the ground, with dispersion of higher flows over <br /> District Property (the "District's System"). <br /> D. The City has agreed to issue the Permit, but one condition of such issuance <br /> is that the District executes this Agreement. <br /> AGREEMENT <br /> For good and valuable consideration,the receipt and sufficiency of which is <br /> acknowledged, the parties agree as follows: <br /> 1. Release. The District hereby releases and fully and forever discharges the <br /> City from any and all claims, demands, debts, guarantees, liabilities, obligations, liens, <br /> 110 8 <br />
