8 <br /> 5.6 General. Metavante shall provide reports of its performance against the Service Levels on a monthly basis. Service Levels <br /> shall be applicable 90 days after the Production-Ready Date. 'Processing Day" shall mean any Monday,Tuesday,Wednesday, <br /> Thursday,Friday,or Saturday which is not declared a holiday by the Federal Reserve Board of Chicago. <br /> (a) Services Level Failures <br /> (1) Excused Performance Problems. Metavante shall not be liable to Customer or pay any Service Level Credits for any <br /> failure to meet a Service Level to the extent that such failure is attributable to:(i)a Force Majeure event;or(ii)acts or omissions of <br /> Customer; or (ill) breaches of the Agreement by Customer. The foregoing are referred to herein collectively as an 'Excused <br /> Performance Problem <br /> (2) Single Point of Contact. Regardless of whether any failure by Metavante to meet a Service Level is attributable to <br /> Metavante or an Excused Performance Problem, and without limitation on Metavante's obligations to address such failure as otherwise <br /> specified in this Schedule,Metavante shall provide a single point of contact in the form of a toll-free number to address resolution of such <br /> failure and shall act promptly to address the problem causing the failure. <br /> (b) Additions and Modifications to Service Levels <br /> (1) Replacement Systems. In the event that any applicable system or function used by Metavante to provide a Service is <br /> replaced during the Term by a comparable system or function,the Service Level shall,to the extent reasonably practicable,be defined <br /> during the first sixty(60)days of operation of such replacement system or function,provided that such Service Level shall be established <br /> at a level Intended to achieve performance at least the same as or better than performance under the Service Level associated with the <br /> replaced system or function. <br /> (2) Documentation of Changes. Any additions or modifications to Service Levels or to the allocation of Service Level <br /> Credit amounts shall be documented in a written amendment to the Agreement(and this Schedule). <br /> (3) Account Volume Growth.
