RIGHT-OF-ENTRY AGREEMENT <br /> for Lowell-Larimer Road Repair Project <br /> REAL ESTATE MANAGER PROJECT: WO# UP3469 <br /> 3200 CEDAR STREET PARCEL ADDRESS: 5931 Lowell-Larimer Rd. <br /> EVERETT, WA 98201 TAX ACCT. #'s: 28050500403800 <br /> OWNER: Hugh Henrickson <br /> This agreement made this day of , 2011, by and between <br /> Hugh Henrickson, (hereinafter referred to as "Owner") and the City of Everett, a <br /> municipal corporation of the State of Washington (hereinafter referred to as <br /> "City"), hereby grants permission to the City, its authorized agents, assigns, or <br /> subcontractors, to enter upon certain lands for the purposes of geotechnical <br /> analysis necessary to identify the scope of work required in connection with the <br /> Lowell-Larimer Road Repair Project. The land to which this agreement applies is <br /> generally described in Exhibit "B", attached hereto and incorporated herein by <br /> reference. However, the City agrees that access shall be limited to that portion of <br /> the property reasonably necessary to accomplish the purposes of this <br /> agreement. <br /> The Owner and the City, by granting and accepting this agreement respectively, <br /> mutually covenant and agree as follows: <br /> 1. The City will make reasonable efforts to minimize disruption and <br /> inconvenience to said property and uses made thereof and City shall provide <br /> reasonable advance notice to Owner prior to its entry or entry of its authorized <br /> agents, assigns, or subcontractors onto property. <br /> 2. This agreement will become null and void at such time as the City has <br /> completed the geotechnical analysis necessary to identify the required scope <br /> of work in connection with the Lowell-Larimer Road Repair Project, and <br /> access is limited to a two week period beginning with the City's first notice of <br /> entry, unless the time is extended solely at the discretion of Owner. A Right- <br /> of-Entry Agreement for future construction is required prior to road repair <br /> construction activities. <br /> 3. The City will provide advance notice to Owner, and give Owner reasonable <br /> time to move, set aside, or displace Owners personal property if it restricts or <br /> hampers the purpose of this agreement. <br /> 4 <br />
