9 <br /> ADDENDUM II <br /> PLANET POWER FACILITY OWNER OBLIGATIONS <br /> This PLANET POWER FACILITY OWNER OBLIGATIONS ADDENDUM is agreed upon in view of the fact <br /> that the Customer may receive an Award for a renewable energy system from Public Utility District No. 1 of <br /> Snohomish County,Washington under its Planet Power program. <br /> The parties hereby agree to the following terms as a condition of the award under the Planet Power program: <br /> I. TERM <br /> This Agreement shall run from the date fully executed and terminates upon permanent disconnection of Cus- <br /> tomer's Generator from the PUD's electric system or ten (10) years, whichever is longer (the "Customer Obli- <br /> gation Period"). <br /> I I. FACILITY OWNER'S OBLIGATIONS <br /> 1. Renewable Energy System Maintenance: During the Customer Obligation Period, the Customer agrees to <br /> operate,maintain and/or repair the Renewable Energy System in full compliance with both the manufacturers' <br /> and the installers' instructions so as to ensure all such warranties remain in full force and effect. During the <br /> Customer Obligation Period, Customer will operate the system for the purpose of powering electrical equip- <br /> ment at the system site or feeding back into the electric power grid,for the purpose of reducing the Customer's <br /> electricity consumption. Customer will maintain the property where the Photo Voltaic ("PV") system is lo- <br /> cated so as to not obstruct the PV System's access to sunlight thereby maintaining minimum solar access of <br /> 75%or greater. In the event that Customer elects to forego repair/replacement, Customer will return a prorated <br /> portion of the 10 year award funds to the PUD. <br /> In the event the roof or any other portion of the physical structure supporting the PV System is repaired, re- <br /> placed, or otherwise modified during the Customer Obligation Period, Customer is responsible for having the <br /> PV system returned to full operation no later than sixty(60)days following completion of the roof or other re- <br /> pairs. Customer agrees that the value of the project is not limited to the electricity it generates and the PUD is <br /> entitled to full or partial reimbursement of award funds in the event of extended inoperability. <br /> In the event the equipment requires repair or replacement, or modification during the Customer Obligation Pe- <br /> riod, Customer is responsible for having the PV system returned to full operation within sixty(60)days. Cus- <br /> tomer agrees that the value of the project is not limited to the electricity it generates and the PUD is entitled to <br /> full or partial reimbursement of award funds in the event of extended inoperability. <br /> In the event the equipment is damaged or destroyed during the Customer Obligation Period, Customer is re- <br /> sponsible for having the PV system returned to full operation within sixty(60)days.
