6 <br /> AMENDMENT NO.2 TO AGREEMENT between <br /> City of Everett and <br /> Alderwood Water and Wastewater District(AWWD) <br /> Regarding <br /> Everett Evergreen Pump Station and AWWD Pump Stations 1 & 2 <br /> WHEREAS,Alderwood Water&Wastewater District("District") and the City of Everett <br /> ("City")have an agreement, dated September 14, 2009 ("Agreement") and amended by <br /> Amendment No. 1 on October 11, 2010, for the purposes of allocating responsibility <br /> between the District and the City for the study and design of electrical supply improvements <br /> related to District and City facilities, especially the pump stations on Evergreen Way at <br /> Everett's Reservoir#3; and <br /> WHEREAS, the parties wish to include the latest cost estimate from the Snohomish County <br /> Public Utility District No. 1 ("PUD")to complete the previously approved time and material <br /> PUD Construction Contract; and <br /> WHEREAS, the parties wish to amend the agreement by allocating responsibility for <br /> additional construction costs for the relocations by Frontier Communications necessitated by <br /> the execution of the PUD Construction Contract; and <br /> WHEREAS, the parties wish to amend the agreement by allocating responsibility for <br /> additional engineering services to evaluate surge conditions involving the District's Pump <br /> Station 1,Pump Station 2 and the City's Evergreen Way Pump Station as shown in a Scope <br /> of Work and Budget which has been jointly developed by the District and City with <br /> Kennedy/Jenks Consultants Inc who are already under contract with the District; and <br /> NOW THEREFORE, in accordance with Section 12 of the Agreement, the parties agree that <br /> the following modifications contained in this Amendment No. 2 supersede the affected <br /> paragraphs of the Agreement and are incorporated herein as if fully set forth: <br /> Section 1: Purpose. The single sentence in the section is amended with the addition of the <br /> following language: <br /> and Surge Evaluation. <br /> Section 3: District Responsibilities. The following paragraph is added at the end of the <br /> section: <br /> The District shall be responsible for administering the additional Surge Evaluation <br /> Scope of Work and paying Kennedy/Jenks Consultrnts. The District shall involve <br /> the City in the meetings to discuss the Surge Evaluation. A copy of the final <br /> Scope of Services and Budget with Kennedy/Jenks is attached to Amendment No. <br /> 2. <br /> 20- <br />
