The attached Construction and <br /> Maintenance agreement compensates BNSF for necessary right of way easements,train signal equipment, <br /> and cost for BNSF train flagging(est. $729,151). <br /> Once completed,the improvements will also meet ancillary City obligations of the Property Disposition <br /> Agreement signed with OliverMcMillan for the Riverfront development. <br /> The improvements are scheduled to start construction this summer. <br /> RECOIVIlVIENDATION(Exact action requested of Council): <br /> Authorize Mayor to sign Grade Crossing Construction and Maintenance Agreement,Easement, and <br /> Memorandum of Agreement with BNSF for improvements at Pacific Ave and Eclipse Mill Road <br /> Intersection. <br /> 3 <br />
