exceed One Thousand Dollars ($1 ,000) or imprisonment in jail for a term not <br /> exceeding ninety (90) days or both such fine and imprisonment. <br /> B. Each day that any violation of, or failure to comply with, this <br /> ordinance is committed and permitted to continue, shall constitute a <br /> separate and distinct offense under this section and shall be punishable as <br /> such hereunder; provided, however, that the Court may, in appropriate cases, <br /> stay the cumulation of penalties. <br /> SECTION 16: Severability. <br /> If any one or more of the provisions, sections, covenants or agreements <br /> provided in this ordinance to be performed by the City shall be declared by <br /> any court of competent jurisdiction to the contrary to law, then such <br /> provision, section, covenant or agreement shall be null and void and shall <br /> be deemed separable from the remaining provisions, sections, covenants or <br /> agreements in this ordinance and shall in no way affect the validity of the <br /> other provisions of this ordinance. <br /> SECTION 17: General Duty. <br /> It is expressly the purpose of this ordinance to provide for and promote the <br /> health, safety and welfare of the general public and not to create or <br /> otherwise establish or designate any particular class or group of persons <br /> who will or should be especially protected or benefited by the terms of this <br /> ordinance. <br /> It is the specific intent of this ordinance that no provisions nor any term <br /> used in this ordinance is intended to impose any duty whatsoever upon the <br /> City or any of its officers or employees, for whom the implementation and <br /> enforcement of this ordinance shall be discretionary and not mandatory. <br /> Nothing contained in this ordinance is intended nor shall be construed to <br /> create or form the basis of any liability on the part of the City, or its <br /> officers, employees or agents, for any injury or damage resulting from any <br /> action or inaction on the part of the City related in any manner to the <br /> enforcement of this ordinance by its officers, employees or agents. <br /> SECTION 18: Repealer. <br /> Ordinance Nos. 570-78, 781 -81 and 835-82 (Chapter 5.72 EMC) and all other <br /> ordinances in conflict herewith are hereby repealed. <br /> 9 <br />
