ARTICLE 2 - NON-DISCRIMINATION <br />The City agrees not to discriminate against any person or employee for his/her activity in behalf <br />of or membership in the Union. The Union and the City agree not to engage in unlawful <br />discrimination against any person or employee because of race, color, sex, creed, national <br />origin, age, marital status, sexual orientation, or the presence of a physical or mental disability, <br />unless it is a bona fide occupational qualification. <br />The City and the Union, recognizing the need for affirmative action, do mutually agree to be <br />supportive to the City's Affirmative Action Plan in striving to provide opportunities for meaningful <br />employment of those persons or groups who have been victims of discrimination. The City's <br />Affirmative Action Plan shall not change the existing bargaining Agreement or seniority rights of <br />those employees covered by this Agreement - <br />2 <br />
