• <br /> SECTION 4 . Subsection 34.070 of Ordinance 1671-89, which reads: <br /> 34.070 Modification of Parking Requirements. <br /> A. An applicant may request a modification of the parking <br /> requirements of this Ordinance. The Review Authority and review <br /> process shall be based upon the following criteria: <br /> 1. Uses which are reviewed using Review Process III or V shall <br /> have requests for a modification of parking requirements <br /> considered during the review process for that use. <br /> 2 . Variances requesting a reduction of parking requirements by <br /> more than ten percent, which are not being considered <br /> concurrently with a use which requires Review Process III or <br /> V shall be considered using Review Process IV. <br /> 3 . Requests for a modification of parking requirements of not <br /> more than ten percent may be reviewed by the Planning <br /> Director using Review Process II.B, subject to the following <br /> requirements: <br /> a. The Planning Director may approve a request for such a <br /> modification only if such a request is supported by the <br /> City Traffic Engineer, based upon information or <br /> documentation contained in a parking analysis, as may <br /> be required by the Traffic Engineer. <br /> b. The Planning may not approve a modification of parking <br /> standards for residential uses. <br /> c. The decision of the Planning Director on a request to <br /> modify parking requirements shall be subject to appeal <br /> to the Hearing Examiner, as provided in Subsection <br /> 41. 180. <br /> d. In approving a request for a modification to reduce <br /> parking standards by not more than ten percent, the <br /> Planning Director shall not be required to make the <br /> findings required for variances, described in Section <br /> 41 , but shall issue written findings which are <br /> substantiated by the information required by Subsection <br /> 34.070.B. <br /> B. In considering a request for a modification of parking <br /> requirements, the Review Authority shall consider the following <br /> factors: <br /> 1. Type of use proposed and traffic generation, including hours <br /> of operation, frequency of employee and customer trips, and <br /> other specific factors relating to the proposed use. <br /> 2. Location of the subject property, proximity to and <br /> availability of public transportation facilities, likelihood <br /> of customers or employees to use public transportation. <br />
