• e <br /> EVERETT <br /> ORDINANCE NO. 1792-91 <br /> AN ORDINANCE relating to fireworks, adding five new sections to <br /> Ordinance No. 1041-84 (EMC Chapter 16.60) , repealing <br /> Section 10 of Ordinance No. 1041 -84 (EMC Chapter <br /> 16.60.110) , and establishing effective dates for the new <br /> sections added to Ordinance No. 1041 -84. <br /> WHEREAS, the Everett City Council encourages and supports the patriotic <br /> public display of fireworks performed by professionals on Independence Day; <br /> and <br /> WHEREAS, the Everett City Council is concerned about the personal injury and <br /> property damage caused each year by the irresponsible use of fireworks; and <br /> WHEREAS, the Everett City Council finds that most fireworks are inherently <br /> dangerous, and more restrictions should be placed on the sale of fireworks <br /> within the City of Everett; and <br /> WHEREAS, the Everett City Council finds that the type of fireworks sold in <br /> the City of Everett should be made more restrictive than State law in <br /> accordance with RCW 70.77.250(4) ; and <br /> WHEREAS, the City of Everett must wait one year before placing limitations <br /> on the type of fireworks sold which are more restrictive than State law; and <br /> WHEREAS, the Everett City Council finds, to reduce the number of injuries to <br /> persons and damage to property, the discharge of fireworks should be allowed <br /> only on the Fourth of July of each year; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : A new section is hereby added to Ordinance No. 1041-84, to be <br /> codified as a new section of EMC Chapter 16.60, to read as follows: <br /> Hours of Sale. <br /> No common fireworks shall be sold within the city limits of <br /> Everett except from 12:00 noon on the 28th of June to 12:00 noon <br /> on the 6th of July of each year. No common fireworks may be sold <br /> between the hours of 11 :00 p.m. and 9:00 a.m. <br /> Section 2: A new section is hereby added to Ordinance No. 1041-84, to <br /> be codified as a new section of EMC Chapter 16.60, to read as follows: <br />
