• <br /> Prohibited Fireworks. <br /> Nothwithstanding the provisions of Section 1 of this <br /> ordinance, it shall be unlawful to sell or offer for sale the <br /> following fireworks: Aerial devices, as defined in WAC <br /> 212-17-035(2)(a) , (b) and (c) , as now or hereafter amended. <br /> Section 3: A new section is hereby added to Ordinance No. 1041-84, to be <br /> codified as a new section of EMC Chapter 16.60, to read as follows: <br /> Hours of Discharge. <br /> Unless otherwise allowed by permit, no fireworks may be <br /> discharged within the city limits of Everett except between the <br /> hours of 9:00 a.m. and 11 :00 p.m. on the fourth of July of each <br /> year. <br /> Section 4: A new section is hereby added to Ordinance No. 1041-84, to be <br /> codified as a new section of EMC Chapter 16.60, to read as follows: <br /> Discharge of Aerial Devices Prohibited. <br /> Unless otherwise allowed by permit, it shall be unlawful to <br /> discharge the following fireworks within the City limits of <br /> Everett: Aerial devices, as defined in WAC 212-17-035(2)(a) , (b) <br /> and (c) , as now or hereafter amended. <br /> Section 5: A new section is hereby added to Ordinance No. 1041 -84, to be <br /> codified as a new section of EMC Chapter 16.60, to read as follows: <br /> Sale to Minors. <br /> A. It shall be unlawful for anyone to sell or attempt to sell <br /> any fireworks to any person under the age of sixteen years. <br /> B. A violation of this section is a gross misdemeanor. <br /> C. In any prosecution under this section, it is not a defense <br /> that the actor reasonably believed that the other person <br /> was sixteen years of age or older. <br /> Section 6: Effective Date. <br /> Pursuant to RCW 70.77.250(4) , Section 2 of this ordinance shall take effect <br /> on the 28th day of June , 1992, a date more than one year after <br />
