• ORDINANCE NO. / An Ordinance of the City of Everett Amending Section 42. 130 of Zoning Ordinance #1671-89 (EMC 19.42.130) Concerning City Council Review of Planning Commission Recommendations, and Declaring an Emergency to Exist. WHEREAS, the City of Everett adopted Zoning Code Ordinance No. 1671-89 which became effective on January 13 , 1990; and WHEREAS, Section 42 of the zoning code establishes the review procedures for making changes to the text of the zoning code; and WHEREAS, said Section 42 does not allow for the City Council to approve portions of a Planning Commission recommendation on changes to the text of the zoning code unless it approves the entire recommendation or remands the entire recommendation to the Planning Commission; and WHEREAS, the City Council asked the Planning Commission to consider an amendment to the zoning code which would allow the City Council to approve portions of a Planning Commission recommendation with which it agrees while remanding those portions about which it has concerns to the Planning Commission for further consideration; and WHEREAS, the Planning Commission reviewed the proposed amendment to Section 42.130 of the zoning code and has recommended that the City Council approve the proposed amendment; and WHEREAS, the City Council finds that: 1. The proposed amendment is not in conflict with any of the provisions of the Everett General Plan. 2 . The proposed amendment bears a substantial relation to the public welfare. 3 . The proposed amendment is in the best long term interests of the Everett Community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: sRewrinu 1 Subsection 42.130.0 of Ordinance No. 1671-89 (EMC 19.42.130.C) , which presently reads: C. Planning Commissinn Aotinn - Referral to city council- All actions taken by the Planning Commission under paragraphs A and B of this subsection take the form of a recommendation to the City Council. In reviewing the recommendations of the Planning Commission, the City Council shall have the authority to take either of the following actions:
