1 . If the City Council agrees with the recommendations of the <br /> Planning Commission, it may approve the proposed action as <br /> recommended; or <br /> 2. If the City Council disagrees with the recommendation of the <br /> Planning Commission, or wishes to make changes to the <br /> recommendation, it shall remand the matter to the Planning <br /> Commission, identifying the specific areas of concern it <br /> wishes to be reconsidered by the Planning Commission. Upon <br /> referral of the matter back to the City Council following <br /> reconsideration by the Planning Commission, the City Council <br /> may approve, disapprove, or modify the proposal. <br /> is hereby amended to read: <br /> C. Planning CnmmisRinn Action - gpfPrral to City CniinCil _ All <br /> actions taken by the Planning Commission under paragraphs A and B <br /> of this subsection take the form of a recommendation to the City <br /> Council . In reviewing the recommendations of the Planning <br /> Commission, the City Council shall have the authority to take <br /> either of the following actions: <br /> 1. In reviewing the recommendations of the Planning Commission <br /> as it relates to actions identified in paragraph A, the City <br /> Council shall have the authority to approve the proposal, <br /> sections or subsections thereof. If the City Council wishes <br /> to make changes to the proposal, sections or subsections <br /> thereof, it shall remand those portions of the proposal <br /> about which it has concerns to the Planning Commission for <br /> further consideration. Upon referral of the matter back to <br /> the City Council, the City Council may approve, disapprove <br /> or modify the proposal . <br /> 2. In reviewing the recommendation of the Planning Commission <br /> as it relates to actions identified in paragraph B, the City <br /> Council shall have the authority to approve the <br /> recommendation, or if it disagrees with the recommendation <br /> it shall remand the proposal to the Planning Commission for <br /> further consideration. Upon referral of the matter back to <br /> the City Council , the City Council may approve, disapprove <br /> or modify the proposal . <br /> SFCTTON 1 : This is a public emergency ordinance necessary for <br /> protection of the public health, safety and welfare; and shall <br /> be made effective upon becoming valid. <br /> SECTTCH 4: Severability. If any section, subsection, clause, <br /> phrase or any portion of this ordinance or the attached <br /> resolution is for any reason held to be invalid or <br /> unconstitutional by the decision of any court of competent <br /> jurisdiction, such decision shall not affect the validity of <br /> the remaining portions of this ordinance or attached <br /> resolution. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and the <br /> attached resolution and each section, subsection, sentence, <br /> clause, phrase or portion thereof irrespective of the fact that <br /> any one or more sections, subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br />
