I <br /> All dates in this schedule are subject to change as deemed necessary by the City.Developers will <br /> be notified by Addendum of any changes. <br /> 4.4 City Answers and Addenda <br /> Changes to this RFP will be made only by formal written addenda issued by the City's RFP <br /> Coordinator. Any such addenda and City answers to questions will be issued no later than the <br /> date and time listed in Section 4.3 and only to those who asked questions and/or submitted a letter <br /> of interest that includes the email or fax of the interested party. Changes to this RFP may be <br /> made by the City if,in the sole judgment of the City,the changes will not compromise the City's <br /> objectives. <br /> 4.5 Proprietary Material <br /> Developers should be aware that the City is required by law to make its records available for <br /> public inspection,with certain exceptions(see RCW Chapter 42.56).Developers shall clearly <br /> mark any proprietary information contained in its Proposal with the words"proprietary <br /> information." Marking all or nearly all of a Proposal as proprietary may result in rejection of the <br /> Proposal. Developers should be aware that even materials marked"proprietary information"may <br /> be subject to public inspection.The Developer,by submission of materials marked proprietary, <br /> acknowledges and agrees that the City will have no obligation to advocate for nondisclosure in <br /> any forum or any liability to the Developer in the event the City must disclose these materials. <br /> 4.6 Delivery of Proposals <br /> The City will not consider Proposals submitted by facsimile. Developers are solely responsible <br /> for ensuring that proposals are delivered on time,and proposals not timely submitted will not be <br /> considered. <br /> 4.7 Cost of Participation in RFP Process <br /> The City shall not be liable for any costs incurred by Developers in the preparation,submittal of a <br /> proposal or participation in the RFP process. <br /> 4.8 Withdrawal of Proposals <br /> A proposal may be withdrawn by written request of the Developer prior to the opening of the <br /> proposals on the date specified in Section 4.3. <br /> 4.9 Changes in Proposals <br /> Prior to the opening of the proposals,a Developer may make changes and resubmit its proposal. <br /> 4.10 Rejection of Proposals <br /> The City reserves the right to reject any and all proposals and to waive any immaterial defects <br /> and irregularities in proposals. <br /> 4.11 City-Requested Clarifications <br /> The City reserves the right to request clarification of information submitted and to request <br /> additional information from any Developer. <br /> Smith Street TOD-RFP Page 7 <br /> 9 <br />
