REQUEST FOR PROPOSALS <br /> General Contractor/Construction Manager Services for <br /> EREfiefft- Water Pollution Control Facility Expansion-Phase C <br /> negotiate with the next highest scored firm, and continue until an agreement <br /> is reached or the process is terminated. Should the City choose to terminate <br /> the negotiations due to failure to successfully negotiate a Phase C2 MACC, <br /> such termination will be effective upon acknowledgement of receipt of written <br /> notification to the Contractor. If for any reason the City and the selected <br /> contractor do not enter into an amended GC/CM Construction Contract for <br /> Phase C2 after the contractor's performance of the Phase C2 Preconstruction <br /> Services, the contractor shall have no recourse whatsoever against the City <br /> for such failure to enter into a GC/CM Construction Contract. <br /> J. Compliance with RFP and RFFP: Failure by a Proposer to comply with the <br /> requirements of this RFP or RFFP may result in the City declaring the <br /> Proposal or Final Proposal as non-responsive. <br /> 6.0 REQUEST FOR INFORMATION AND ISSUANCE OF ADDENDA <br /> A. Proposers who contact <br /> any other City employee or consultant with questions may have their proposal <br /> declared non-responsive. Questions must be received by the City no later <br /> than 5pm PST, May 4, 2012. <br /> C. Addenda Response to RFIs: The City will provide binding answers to RFIs <br /> only via addenda which shall be published on the City's website by the City <br /> Purchasing Department.
