REQUEST FOR PROPOSALS <br /> 1 /144"----,„/•,./ <br /> `�''` General Contractor/Construction Manager Services for <br /> `P. ArefirW Water Pollution Control Facility Expansion-Phase C <br /> 3. Protest of Contents of RFFP. The protest of any provision of the RFFP <br /> (including any evaluation criteria, term, requirement, deadline, or <br /> condition) must be filed with the City Clerk no later than three (3) <br /> business days after issuance of the RFFP. This includes without <br /> limitation any protest of any provision of the RFFP and any protest of <br /> any provision in the form GC/CM contract or any other contract form <br /> issued with the RFFP. If the protest decision results in a change to the <br /> RFFP, an addendum .will be issued identifying the new or revised <br /> RFFP provisions. <br /> 4. Protest of City Selection. The protest of the City's selection of the <br /> GC/CM contractor must be filed with the City Clerk no later than three <br /> (3) business days after notification of the selection. (Assuming that the <br /> notification occurs on July 20, 2012, this means the protest deadline is <br /> July 25, 2012.) <br /> B. Debriefing: Proposers may request a debriefing within 5 calendar days of <br /> being notified of the selection of the top ranked firm. Debriefings may include <br /> a review of the debriefed Proposer's points for each evaluation criteria, overall <br /> ranking, the strengths and weaknesses of its Proposal and presentation in the <br /> Interview, and answers to questions regarding the selection process. <br /> Debriefings will not occur until the final resolution of all protests. <br /> 15.0 OTHER PROVISIONS <br /> A. The City reserves the right to reject any and all Proposals at any time and to <br /> choose not to award and/or execute a contract(s), even after a notice of <br /> selection has been issued. Proposers acknowledge that a notice of selection <br /> confers no right of contract. The City may cancel the procurement and reject <br /> all proposals for any reason. By submitting a Proposal, the Proposer <br /> acknowledges and agrees that the City may cancel the procurement, reject <br /> any and all Proposals or not enter into a contract, all without any liability of <br /> any kind to the Proposer. <br /> B. In submitting a Proposal, the Proposer agrees that in the event of any <br /> litigation arising from or relating to this RFP, proposals in response to this <br /> RFP or any related process, the exclusive venue of such litigation will be the <br /> Snohomish County Superior Court, and the applicable law is the law of the <br /> State of Washington. <br /> END OF RFP <br /> City of Everett Page 35 April 16, 2012 <br /> Water Pollution Control Facility Expansion-Phase 038 <br />
