1 <br /> 5. IPMC 304.2 Protective treatment: All exterior surfaces, including but not limited to, <br /> doors, door and window frames, cornices, porches, trim, balconies, decks and <br /> fences, shall be maintained in good condition. Exterior wood surfaces, other than <br /> decay-resistant woods, shall be protected from the elements and decay by painting <br /> or other protective covering or treatment. Peeling, flaking and chipping paint shall <br /> be eliminated and the surfaces re-painted. <br /> 6. EMC §1.20.020 (E) (1) "Repeat Violator" means any person, firm, corporation, <br /> association, or agent thereof who has had any order issued pursuant to the <br /> provisions in this chapter, including any order issued subsequent to a hearing, any <br /> stipulated order and any default order, and within twenty-four months of the <br /> issuance of such order commits or allows to be committed a new and separate <br /> violation of a same or similar chapter of the Everett Municipal Code that is <br /> enforceable under this chapter, regardless of location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By allowing junk, trash and miscellaneous debris to be discarded and remain on the <br /> above mentioned property the Respondents have violated EMC §8.20.020 (A). The <br /> violation is a public nuisance. <br /> 2. The Respondents are repeat violators. The Hearing Examiner issued an Order <br /> relating to the property within the past twenty-four months on the property violations. <br /> 3. By allowing grass, weeds and blackberry vines to become overgrown and remain <br /> on the above mentioned property, the Respondents have violated EMC §8.20.020 <br /> (E). The violation is a public nuisance. <br /> 4. By allowing household garbage to accumulate and remain on the above mentioned <br /> property the Respondents have violated IPMC 308.1. The violation is a public <br /> nuisance. <br /> 5. By not providing approved covered containers for rubbish and garbage the <br /> Respondents have violated IPMC 308.2.1. The violation is a public nuisance. <br /> 6. By not disposing of rubbish and garbage in a clean and sanitary manner the <br /> Respondents have violated IPMC 308.3. The violation is a public nuisance. <br /> 7. By not applying adequate protective treatment to the exterior surfaces of the <br /> occupied residence the Respondents have violated IPMC 304.2. <br /> 8. All parties have received notice of all hearings and proceedings in this matter. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 10 6 <br />
