1. The Respondents shall abate all violations of EMC §8.20.020 (A)junk, trash and <br /> miscellaneous debris discarded on the property; EMC §8.20.020 (E)tall grass <br /> weeds and blackberry on property; IPMC 308.1 accumulation of garbage on the <br /> property and IPMC 304.2 exterior surface of residence without protective treatment <br /> on the property located at 5630 Commercial Avenue, Everett,Washington. <br /> 2. All abatement of the violations on said property shall be completed by January 6, <br /> 2012. Cleanup and abatement shall include: <br /> a.. Remove and properly and legally dispose of miscellaneous junk, trash and <br /> debris. <br /> b. Cut and properly and legally dispose of overgrown grass,weeds and blackberry <br /> vines. <br /> c. Dispose of all household garbage in a clean and sanitary and legal manner. <br /> d. Provide residence with approved covered containers for all rubbish and garbage. <br /> Rubbish and garbage shall be stored in approved and covered containers and <br /> removed from the property on a regular basis. <br /> e. The exterior surface of the residence shall be properly prepared and shall have a <br /> new coat of paint applied, or other alternative protective treatment applied to the <br /> exterior walls of the residence. <br /> 3. The Respondents being repeat violators within twenty four months as defined by <br /> EMC §1.20.020 (E)(I), shall be fined joint and several $1000.00 for each repeat <br /> violation of EMC §8.20.020 and $500.00 for the initial violation of EMC §8.20.020; <br /> IPMC 308.1; IPMC 308.2.1; IPMC 308.3 and IPMC 304.2 for a total fine of <br /> $3,500.00. <br /> 4. The Respondents shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondents shall pay the$3,500.00 fine no later than January 13, 2012. <br /> Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, <br /> Everett Washington, 98201. If payment is not made on or before January 13, <br /> 2012, collection action will be taken, which may include assigning the debt to a <br /> collection agency pursuant to EMC §1.20.050(D). <br /> 6. This written Order shall be controlling over any conflicts with oral Orders issued at <br /> the Public Hearing. <br /> 11 7 <br />
