INFORMATION FOR DEVELOPER: <br /> The following information is provided for the developer's benefit. These are not SEPA conditions. All <br /> requirements are preliminary in nature, and are based upon the preliminary site plan and the <br /> ordinances in effect at time of submittal for SEPA review. The proposal must comply with all <br /> ordinances in effect at the time a complete building permit application is filed, including those not <br /> specifically set forth herein. (Exception: For vesting under the Zoning Code, please refer to Section 44 <br /> of the Zoning Code). (A Stormwater Site Plan was submitted prior to February 15,2010 and <br /> subsequently approved for proposed lots_1 and 2).Contact the Planning Department for information <br /> regarding appeals processes for the requirements listed in this document. <br /> AGENCIES WITH JURISDICTION <br /> 1. The Snohomish Health District issued a Solid Waste Facility permit for this site in July 2011 <br /> (#SW-204). This permit addresses an "inert waste landfill",which authorizes placement of <br /> wastes such as cured concrete,asphaltic materials, brick/masonry and other materials. The <br /> permit is valid through June 30, 2012. Prior to issuance of construction permits, the Applicant <br /> will be required to file a 60-day closure notice with the District,with a closure plan for the inert <br /> waste landfill fill to be approved by the District. <br /> • Contact at the Health District is Kathy Pierson,at 425-339-5250 <br /> • Contact at Cemex Development is David Spivey, at 425-388-1844 <br /> 2. A Construction Stormwater General Permit, administered by the Department of Ecology,will be <br /> required for this project. Additional information as well as an application form can be found on <br /> the DOE website at: www.ecy.wa.gov/programs/wq/stormwater/construction. <br /> RELEVANT CONDITIONS FROM SW EVERETT MITIGATION DECISION DOCUMENT <br /> Note: These are generalized conditions applicable to projects within the SW Everett Sub-area. The City <br /> has imposed additional requirements that may be more specific or restrictive than the requirements in <br /> this section. In the event of a conflict between the mitigation listed within this section and additional <br /> conditions listed in"Other Requirements",the items listed under Other Requirements shall take <br /> precedence since they are based on a detailed review of a specific development application. <br /> Section 1: LAND USE <br /> 1.1 Thresholds <br /> Height of Buildings/Structures <br /> Additional SEPA analysis is required for any structure that the FAA determines may have a significant adverse <br /> effect on navigable airspace around Paine Field Airport. <br /> Additional SEPA analysis is required for any project located in the M-1 zone east of Hardeson Road with a proposed <br /> building height greater than 65 feet. The analysis must assess impacts to views from the residential areas to the <br /> south and east. <br /> Permitted and Accessory Uses <br /> Tables 1-1 and 1-2 list the permitted uses and accessory uses/activities covered in this EIS analysis. <br /> 3 <br />
