31 • <br /> AMENDMENT NO. 1 TO LICENSE TO USE CITY PROPERTY <br /> FUN TIMES <br /> THIS AMENDMENT NO. 1 TO LICENSE TO USE CITY PROPERTY (the <br /> "Amendment") is made and entered by and between the City of Everett(the "City") and FUN <br /> TIMES Ice Cream("Fun Times"). <br /> WHEREAS, as of May 21, 2012, the City and Fun Times entered into a License to <br /> Use City Property (the "License") for the properties specified therein for specified monthly <br /> payments; and <br /> WHEREAS, Fun Times is being requested to now vend at all City parks since the <br /> prior vendor, AMH, who vended certain City parks had their contract terminated June 15, <br /> 2012,and <br /> WHEREAS,Fun Times will vend all City parks and will increase their total payments <br /> for July, August,and September by$150; <br /> NOW THEREFORE,the City and Fun Times do mutually agree as follows: <br /> 1. Section 5 is hereby deleted in its entirety and replaced with the following: <br /> Section 5. MONTHLY FEE. FUN TIMES shall pay the City a yearly <br /> total of $4,190, according to the below specified payment schedule for each <br /> year that this Agreement is effective. Payment must be made on or before the <br /> 10th of the month in which it is due. <br /> Month Amount <br /> April $105.00 <br /> May 210.00 <br /> June 310.00 . <br /> July 1,730.00 <br /> August 1,620.00 <br /> September 190.00 <br /> October 25.00 <br /> Yearly Total . $4,190.00 <br /> The Director of the Parks and Recreation Department may amend the yearly <br /> total and monthly fee payment amounts due under the remaining term of the - <br /> Agreement by letter agreement. <br /> • <br /> 2.
