1 <br /> 16.Sgt. Bosman is familiar with the Best Inn and the history of unlawful activity <br /> occurring at the location. Sgt. Bosman has worked for the Everett Police <br /> Department ("EPD") for 14 years and has acquired general knowledge of the City <br /> and various areas that are higher in crime, including the Best Inn. <br /> 17.From 2001 to 2004 Sgt. Bosman was a member of the Everett Police Anti-Crime <br /> Team ("ACT"). During his time with ACT he conducted undercover operations at the <br /> Best Inn. <br /> 18.Between January 1, 2012 and March 20, 2012, the EPD responded to 3 calls to the <br /> Best Inn that appeared to be drug related. These contacts are documented in the <br /> reports attached as Exhibit 6. <br /> 19.Calls for service to the Best Inn have been primarily generated internally by Everett <br /> Police Officers. There are few calls from Everett citizens for two reasons: (1) The <br /> hotel is situated away from residences and is flanked by commercial establishments <br /> that are closed after normal business hours; and (2) The known history unlawful <br /> activity on N. Broadway generally and at the Best Inn has caused increased patrols <br /> at the Best Inn. <br /> 20.During this period, EPD officers made informal recommendations to Best Inn to <br /> reduce this criminal activity. Officers cautioned that the Best Inn may become a <br /> chronic nuisance property. Best Inn did not take sufficient steps to eliminate the <br /> unlawful activity. <br /> b. Chronic nuisance investigation. <br /> 21.1n March 2012, the Best Inn again caught Sgt. Bosman's attention. The City <br /> prosecutor's office noted to Sgt. Bosman that it was seeing the location of the Best <br /> Inn appear on several of its cases. And on March 12, 2012, a family of three from <br /> Vancouver rented a room at the Best Inn. Less than half of an hour later, after <br /> learning that the heater and several lights did not work, the family asked for their <br /> money back. Ms. Ahn refused stating that she did not provide refunds ten minutes <br /> beyond renting the room. Exhibit 5. <br /> 22.Sgt. Bosman's concern for the public, together with his knowledge of the history of <br /> unlawful activity occurring at this location prompted him to begin an investigation of <br /> the Best Inn as a possible chronic nuisance property.1 Everett Police Report No. <br /> DD12-5270 is provided as Exhibit 7 and summarizes Sgt. Bosman's investigation. <br /> 23.Sgt. Bosman determined that the Best Inn fit the definition of a chronic nuisance <br /> property after his review of police records revealed three separate incidents of <br /> A chronic nuisance property is a property that has had three or more nuisance activities occur on or near the <br /> property within sixty days that involve the person in charge of the property or their guests or invitees. This matter <br /> does not address whether the Best Inn is a chronic nuisance property. <br /> 16`' <br />
