4 <br /> Applicable Law: <br /> 1. IPMC 108.1.4 Unlawful Structure, which reads: i <br /> An unlawful structure is one found in whole or in part to be occupied by more <br /> persons than permitted under this code, or was erected, altered or occupied <br /> contrary to law. <br /> 2. IPMC 106.1 Unlawful Acts, which reads: <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in <br /> violation of any of the provisions of this code. <br /> 3. IRC 2009 R105.1 Permit required, which reads: <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convertor replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> 4. EMC 19.37.040(D) Critical Area Features, which reads: <br /> E <br /> On all lots containing or adjoining critical areas, the following features and their <br /> buffers shall not be altered or developed except as otherwise permitted by this <br /> chapter: <br /> (D) Fish and wildlife habitat conservation areas, including streams/riparian areas, <br /> lakes and ponds less than twenty acres in size, habitats of primary association, <br /> continuous vegetative corridors linking watersheds, and significant biological <br /> areas listed in Section 37.140.A.5,- <br /> 5. <br /> 7.140.A.5,5. EMC 19.37.170(A)4 Standard Stream Buffer Requirements, which reads: <br /> (A) Standard Buffer Width.
