5 <br /> 2. Unpermitted construction, including placement of a concrete slab and alterations to <br /> a garage structure, is unlawful as defined by IPMC 108.1.4 and is a violation of <br /> IPMC 108.1.4. The Respondent is in violation of this City ordinance. <br /> a <br /> 3. The concrete slab in the backyard of the property intrudes into a critical area on site <br /> and is in violation of EMC 19.37.040(D) and EMC 19.37.170(A)4. The Respondent <br /> is in violation of these City ordinances. <br /> e <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent was in violation of IPMC 106.1, IRC R105.1, EMC s <br /> 19.37.040(D) and EMC 19.37.170(A)4 and is hereby ordered to: <br /> s <br /> 1. The Respondent must abate all violations of IPMC 108.1.4, IRC R105.1, EMC <br /> 19.37.040(D) and EMC 19.37.170(A)4 on the property at 27 112th Street SE, <br /> Everett, Washington. <br /> 2. All abatement of the violations on said property must be completed by May 12, <br /> 2016. The abatement shall include: <br /> a. The Respondent shall apply for and obtain all of the necessary and required <br /> permits to bring the property and residential structure into compliance with City <br /> ordinances. The Respondent shall conduct and complete all of the required <br /> work and have the work inspected and approved by the City of Everett Building <br /> Division within 180 days from the date of the hearing or by May 12, 2016. Any <br /> violations not listed in this Order are subject to standard enforcement processes <br /> and procedures. <br /> 3. The Respondent shall be fined $500.00 for violations of IPMC 108.1.4, IRC R105.1, <br /> EMC 19.37.040(D) and EMC 19.37.170(A)4 for a total fine of$2000.00. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondent shall pay the entire $2000.00 fine no later than November 27, g <br /> 2015. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore <br /> Suite 100, Everett Washington, 98201. If payment is not made on or before <br /> November 27, 2015 collection action may be taken, which pursuant to EMC <br /> §1.20.050(D) may include assignment of the debt to a collection agency. <br /> i <br /> 6.
