3 <br /> _ = Preconstruction Services Contract <br /> General ContractorlConstruction Manager Services for <br /> Water Pollution Control Facility Expansion <br /> Phase C1 (Liquid Stream), Phase C2(Solids Handling) <br /> (MACC) for Phase C1 and Phase C2 is not part of the work of this Contract <br /> and will not be paid forby the Owner. The start of MACC negotiations are <br /> defined in item 5 below. <br /> 3. Subcontract Plan: No later than the conclusion of the Design Development <br /> stage, GC/CM shall prepare and submit a Subcontract Plan to Owner for <br /> approval. Among other things the Subcontract Plan shall outline the <br /> subcontract packages with bid package estimates and a procurement <br /> schedule for each package; bidding instructions; standard Subcontract <br /> agreements; and appropriate Subcontractor insurance limits and types by <br /> subcontract bid package. <br /> A. The GC/CM shall make every effort possible to secure at least three <br /> bids for each subcontract and equipment package. If the GC/CM <br /> receives less than three bids, the Owner, at its discretion, may require <br /> that the GC/CM re-bid the package at no additional cost to the Owner <br /> or impact to the schedule. This applies to all subcontract and <br /> equipment bid packages including the packages whereby the GC/CM <br /> decides to submit a bid. <br /> 4. Early Subcontract Bidding and Selection: Consistent with a) RCW 39.10.370 <br /> (2), the GC/CM may bid major subcontract bid packages for each Phase <br /> before the Owner and GC/CM reach an agreement on the Maximum <br /> Allowable Construction Cost (MACC) for the respective Phase, and/or b) <br /> RCW 39.10.370 (3), the Owner may, at its option, authorize the GC/CM to <br /> proceed with bidding and award of bid packages and construction of such <br /> work before the Drawings and Specifications are complete, and/or c) RCW <br /> 39.10.385 the Owner and GC/CM may agree that the mechanical and/or <br /> electrical subcontractors should be selected through the alternate process <br /> outlined in state law. Early bidding and selection, if any, shall be conducted in <br /> accordance with the Subcontract Plan. All costs and risks associated with <br /> bidding of such bid packages or selection of such subcontractors shall be the <br /> responsibility of the GC/CM. Only to the extent that the GC/CM has included <br /> the costs of such subcontract bidding and selection in its bid for Specified <br /> General Conditions work, and only if the Owner and GC/CM execute a <br /> GC/CM Contract for the respective. Phase, will the GC/CM be reimbursed for <br /> the costs of such subcontract bidding and selection.
