3Preconstruction Services Contract <br /> _ jA General Contractor/Construction Manager Services for <br /> > , - Water Pollution Control FacilityExpansion <br /> Phase Cl (Liquid Stream), Phase C2(Solids Handling) <br /> • <br /> then the Owner shall withhold 5% of each payment to the GC/CM for the <br /> additional work. <br /> 10. Payment and Performance Bonds: A Payment Bond and Performance Bond <br /> are not required for the work of these Preconstruction Services. In the event <br /> that any additional work (beyond the scope defined in this Contract <br /> Attachment B) is negotiated under this Contract and such work is subject to <br /> RCW 39.12 and/or RCW 39.08.010, then GC/CM shall submit separate . <br /> Payment and Performance bonds, each for the full not-to-exceed contract <br /> amount of the additional work and the Owner shall pay the GC/CM for the <br /> documented premium cost to the GC/CM of providing the bonds after the <br /> Parties have executed an amendment to this Contract. <br /> 11. Audits and Inspections. At any time during normal business hours and as <br /> often as the Owner may deem necessary, the GC/CM shall make available to <br /> the Owner for the Owner's examination all of the GC/CM's records and <br /> documents with respect to all matters covered by this Agreement and, <br /> furthermore, the Service Provider will permit the Owner to audit, examine and <br /> make copies, excerpts or transcripts from such records, and to make audits of <br /> all contracts, invoices, materials, payrolls, records of personnel, conditions of <br /> employment and other data relating to all matters covered by this Agreement. <br /> 12. Owner of Everett Business License. GC/CM agrees to obtain a City of <br /> Everett business license prior to performing any work pursuant to this <br /> Agreement. <br /> 13. Compliance with Federal, State and Local Laws. GC/CM shall comply with <br /> and obey all federal, state and Iocal laws, regulations, and ordinances <br /> applicable to the operation of its business and to its performance of work <br /> hereunder. <br /> 14. Compliance with the Washington State Public Records Act. GC/CM <br /> acknowledges that the Owner is subject to the Public Records Act, chapter <br /> 42.56 RCW (the "Act"). All records owned, used or retained by the Owner are <br /> public records subject to disclosure unless exempt under the Act, whether or <br /> not such records are in the possession or control of the Owner or GC/CM. <br /> GC/CM shall cooperate with the Owner so that the Owner may comply with all <br /> of its obligations under the Act.
