EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET 3
PROJECT TITLE:
An Ordinance amending Consent COUNCIL BILL# rra 6D-
Section 3(D) of Chapter 5 of 12-5-12 Action Originating Department Planning
Ordinance No. 2530-01 (EMC 11-21-12 First Reading Contact Person Allan Giffen
15.20.110),providing for an 11-28-12 Second Reading Phone Number 257-8725
extension for land use permits 12-5-12 Third Reading FOR AGENDA OF 11-21, 11-28,
issued under Review Process II 12-5-12 Public Hearing 12-5
and III. 11-21-12 Public Briefing Initialed by: -
Department Head --r
CAA I -
Council President
Location Preceding Action Attachments Department(s)Approval
City-wide A similar Ordinance Ordinance Planning, Legal
(Ord;3118-09) was
adopted in March '09
Amount Budgeted N/A
Expenditure Required N/A
Budget Remaining N/A
Additional Required N/A
DETAILED SUMMARY STATEMENT: In 2009 the City Council, in response to economic challenges
being faced by the development community, adopted an ordinance that provided for a longer time period for
land use permits approved by either the Hearing Examiner or the Planning Director(Review Processes II and
III). That ordinance provided a limited time frame for approved projects to extend the approval that had
been previously granted. Ordinance No. 3118-09 expired December 31,2011.
The economy, though apparently improving, has left several approved projects that comply with current
codes unable to obtain financing or move into construction. The current code provides an 18-month time
frame in which to obtain a building permit, with a possible one-time six-month extension. The proposed
ordinance would create an opportunity for an approved project to remain active for up to an additional two
years beyond the time frame provided in the municipal code. An extension would only be allowed for
projects that comply with City codes at the time of the request for an extension. For example, a project that
was approved under the previous regulations on Evergreen Way,which has since been rezoned, would not be
eligible for an extension of time. The ordinance would expire December 31, 2014.
RECOMMENDATION (Exact action requested of Council): Adopt Ordinance amending Section 3(D)of
. Chapter 5 of Ordinance No. 2530-01 (EMC 15.20.110), providing for an extension for land use permits
issued under Review Process II and III.
5
