An Ordinance Amending Section 3(D) of Chapter 5 of Ordinance No.2530-01 (EMC 15.20.110), Extending the Effective Period for Land Use Permits Issued under Review Processes II and III. WHEREAS,the City adopted Ordinance No. 2530-01 to establish Local Project Review Procedures and implement certain requirements of State law contained in RCW 36.70B; and WHEREAS, Section 3(D)of Chapter 5 of said Ordinance No. 2530-01 (EMC 15.20.110) established an eighteen month effective period for approval of land use permits issued by the City using Review Process II and Review Process III;and WHEREAS,EMC 15.20.110.B provides for an extension of an additional six months by the Planning Director; and WHEREAS,the City of Everett has approved a number of land use permits under Review Processes II and III that have been unable to obtain building permits due to unfavorable economic conditions; and WHEREAS,the City Council finds that the unfavorable economic conditions may result in development projects that meet City codes losing their vesting rights unless additional time can be allowed to secure project financing and building permits; and WHEREAS,the City Council finds that allowing additional time for approved projects to secure project financing and building permits is both necessary and beneficial to the City. NOW,THEREFORE, THE CITY DOES ORDAIN THE FOLLOWING: Section 1. Applicability. The time limits established in this Ordinance the time limits apply to: A. All pending or previously issued Review Process II or III land use permits that have not already expired that meet the provisions stated in Section 2 of this Ordinance; and B. All complete applications submitted between the effective date of this ordinance and December 31, 2014. Section 2.
