0 <br /> AMENDMENT NO.1 TO PROFESSIONAL,SERVICES AGREEMENT BETWEEN <br /> TEM CITY OF EVERETT AND DOUG LEVY d/b/a OUTCOMES BY LEVY <br /> THISt,NDM1ENT NO.1 TO PROlL+'i;SSIONA_L SERVICES AGREEMENT(the <br /> "Amendment")made and entered into this day of January 2013,by and between the City of <br /> Everett(the"City")and Doug Levy d/b/a Outcomes by Levy(the"Service Provider"). <br /> AREAS,the City and the Service Provider entered into a Professional Services Agreement <br /> dated January 1,2012,as amended(the"Agreement");and <br /> WMREAS,the Service Provider has satisfactorily performed the services outlined in the <br /> Agreement;and <br /> VV___EREAS,the Service Provider has proposed to continue services from January 1,2013 to <br /> December 31,2013;and <br /> WEIEREAS,the Service Provider has proposed to change the Scope of Services as attached in <br /> Exhibit A;and <br /> WHEREAS,the City is willing to accept his proposal; • <br /> NOW'THEREFORE the City and the Service Provider mutually agree to amend the Agreement <br /> as follows: <br /> 1. Section 1 of the Agreement is hereby amended so that the work to be perfouied by <br /> Service Provider in 2013 is governed by Attachment A to this Amendment No. 1. <br /> 2. Section 3 of the Agreement ishereby amended to read as follows: <br /> This Agreement will commence on January 1,2013 and will be completed by <br /> December 31,2013. <br /> 3. Section 4D of the Agreement is hereby amended to read as follows: <br /> D. Total compensation,including all services and expenses,shall not exceed a <br /> maximum of One Hundred Forty-Four Thousand Two Hundred($144,200), <br /> which includes$69,600 for 2012,$69,200 for 2013,and$5,000 for expenses. <br /> 4. All other terms and provisions of the Agreement remain in full force and effect except as <br /> expressly modified by this Amendment.
