C. Day laborers will not supervise regular employees nor fill regular vacancies unless <br /> mutually agreed upon between the City and Union. <br /> Section 6: Swim Center <br /> In recognition of the year-round, non-seasonal nature of the activities of the Swim Center, the <br /> parties agree that the Swim Center shall be exempted from the supplanting language and the <br /> time limit provisions identified in Section 2. Although the time limit provisions shall not apply to <br /> positions, the time limit provisions and the applicable work permit fee shall apply to individuals. <br /> The parties also agree that the City will maintain a minimum of three (3) bargaining unit FTEs <br /> assigned to the Swim Center and that the ratio of day laborer hours to regular employee hours <br /> is not increased. That ratio is 6.92 day laborer hours for every hour worked by a regular full- <br /> time employee. The City will produce a report at the end of each calendar year showing the <br /> ratio of day laborer hours to regular employee hours and provide it to the Union. <br /> In addition to the provisions in Section 3, Student Day Laborers employed by the Swim Center <br /> may not work more than twenty-five (25) hours per week. <br /> Page 39 <br />
