• <br /> • Appendix A-1 <br /> OTHER GOVERNMENT AGENCY'S EXECUTION OF THE MEMORANDUM <br /> • OF AGREEMENT • <br /> BETWEEN THE UNITED STATES COAST GUARD, <br /> THE SEATTLE POLICE DEPARTMENT <br /> AND THE EVERETT POLICE DEPARTMENT(Agency) <br /> (Agency), acting by and through (the governing authority),with offices (address).(Other <br /> Government Agency)hereby agrees that: . <br /> (i) This Appendix incorporates by reference the Memorandum of Agreement <br /> between the United States Coast Guard, the Seattle Police Department, and Other <br /> Government Agencies. (Agency) agrees to all provisions outlined in the • <br /> Memorandum of Agreement between the United States Coast Guard, the Seattle <br /> • Police Department, and Other Government Agencies. - <br /> (ii) It has full right, power, authority and capacity and all consents and approvals <br /> necessary to execute and perform this Agreement. <br /> (iii) Once all parties have duly executed this Agreement, it will constitute a <br /> cooperative, valid agreement enforceable against the(Agency) in accordance with <br /> its terms upon its execution. <br /> (iv) It will not assign or transfer this Agreement or any part thereof, or any equipment <br /> or rights therein, to any transferee without the prior written approval of the Coast <br /> Guard and the Seattle Police Department. <br /> (v) It will not give title or possession of anything of substantial value(including <br /> property, currency, travel and/or education programs) to any officer or employee <br /> of the Seattle Police Department or the Coast Guard during the term of this <br /> Agreement or otherwise take any action to violate Seattle Police Department or <br /> Coast Guard ethical policies. • <br /> (vi) It will not issue, nor permit to be issued, any press release, advertisement, or <br /> literature of any kind, which refers to the Seattle Police Department or to the fact <br /> that equipment has been, is being or will be provided to it and/or that services <br /> - have been, are being or will be performed for it in connection with this <br /> Agreement, unless the Agency First obtains the written approval. Such approval <br /> may be withheld if for any reason the Seattle Police Department believes that the <br /> publication of such information would be harmful to the public interest or is in <br /> any way undesirable. <br /> (vii) Upon completion of the AIS equipment installation, (Agency) agrees to accept the <br /> title to the AIS equipment. (Agency) will assume full responsibility for the <br /> operation of the equipment;and upon expiration of the vendor's warranty period, <br /> for its continued maintenance and repair for its useful life. • <br /> (viii) It will provide access to the Seattle Police Department and Coast Guard personnel <br /> to facilitate installation of the AIS equipment. <br /> (ix) It will maintain the Vega on-board display software as required and directed by <br /> the Coast Guard. . <br /> (x) It agrees that the AIS equipment will be operated in accordance with existing <br /> • laws, regulations, prevailing conditions, and any interagency agreements <br /> 32 <br />
