• 7 <br /> MEMORANDUM OF AGREEMENT <br /> BETWEEN THE UNITED STA TES COAST GUARD, <br /> THE SEATTLE POLICE DEPARTMENT <br /> AND OTHER GOVERNMENT AGENCIES • <br /> 1. PARTIES.The parties to this Agreement are the United States Coast Guard(Coast <br /> Guard),the Seattle Police Department and Other Government Agencies(OGAs). Specific <br /> provisions for each Other Government Agency will be incorporated in agency specific <br /> appendices to this agreement. <br /> 2.AUTHORITY.The Coast Guard is authorized to enter into this Agreement under the <br /> provisions of 14 U.S.C. § 141(a)which provides: "The Coast Guard may, when so <br /> requested by proper authority,utilize its personnel and facilities(including members of <br /> the Auxiliary and facilities governed under chapter 23)to assist any Federal agency, <br /> State,Territory,possession,or political subdivision thereof, or the District of Columbia, <br /> to perform any activity for which such personnel and facilities are especially qualified. <br /> The Commandant may prescribe conditions,including reimbursement,under which <br /> personnel and facilities may be provided under this subsection." <br /> 3.PURPOSE.The purpose of this Agreement is to establish terms of agreement by which <br /> the Seattle Police Department will provide Automatic Identification System(AIS) <br /> equipment and the Coast Guard will provide access to the VEGA Electronic Charting <br /> Software(VEGA ECS)and/or to the Coast Guard's Interagency Operations Center <br /> WatchKeeper system via a web interface to partnering government agencies(OGAs),to <br /> improve situational awareness through electronic charting and interoperable command <br /> and control capabilities,including blue force tracking and text messaging using <br /> Encrypted AIS technology. <br /> 4. COAST GUARD'S RIGHTS TO WATCHKEEPER. The Security and Accountability <br /> for Every Port(SAFE Port)Act mandated establishment of Interagency Operation . <br /> Center's(ICCs) in all high priority ports to better plan,coordinate,and execute <br /> operations among interagency partners. In response,the USCG implemented an IOC <br /> initiative,part of which is a major acquisition project to acquire an information <br /> management tool,called WatchKeeper that will enhance interagency operations and <br /> coordinate between federal,state,and local partners. The Interagency Operations Center <br /> WatchKeeper system is consistent with Information Technology (IT)security policy and <br /> procedures within DES Management Directive 4300.1 (Information Technology Systems <br /> Security),DES Sensitive Systems Policy Directive 4300A,and the DES 4300A Sensitive <br /> . Systems Handbook. The Coast Guard hereby represents to the Seattle Police Department <br /> and to the Other Government Agencies unlimited access to all WatchKeeper system <br /> functions that are required to perform official duties in support of maritime security, law <br /> enforcement,safety,and environmental safety missions. Unauthorized access or use of <br /> the WatchKeeper system is prohibited by Title 18, U.S.Code Section 1030. <br /> 5. COAST GUARD'S RIGHTS TO THE VEGA ECS.
