Everett Housing LLC, Respondent, is the owner of property at 2201 Highland ? <br /> Avenue, Everett, Washington (property) which is in an R-2, Single Family Medium <br /> Density Residential zone as established by the City of Everett. Richard L. On March 23, 2012, Mr. Lapinski Jr. applied for building and electrical permits to <br /> bring unpermitted alterations of the residential structure on the property into <br /> compliance with City ordinance. Upon review of Mr. Lapinski Jr.'s permit <br /> application, the City of Everett Planning Department denied the application citing a <br /> number of reasons including: <br /> a. In an R-2 zone a single family residential structure cannot be used as a duplex <br /> or rooming house <br /> b. The zoning code requires a minimum lot area of 7500 square feet for duplexes <br /> c. The thirteen bedrooms in a structure preclude the use of the residence as a <br /> single housekeeping unit having up to four unrelated adults and their related <br /> children and the code allows for four parking spaces instead of the existing <br /> nine.
