After conducting an inspection of the property, the City granted the <br /> reasonable accommodation to Mr. Lapinski Jr. with a condition that the residential <br /> structure on site be brought into compliance with City ordinance. Occupancy was <br /> limited to no more than 12 residents. Approval would not become effective until a <br /> certificate of occupancy or final inspection is approved by the Building Official. <br /> (Exhibit#8, Letter from Allen Giffen dated August 1, 2012) (Testimony of Code <br /> Enforcement Officer Cunningham) <br /> 1 <br /> 4. On August 9, 2016, City of Everett Code Enforcement Officer Don Cunningham and <br /> Mr. Lapinski Jr. conducted an inspection of the property. Mr. Lapinski Jr. informed <br /> Officer Cunningham that 14 people occupied the single family residence in five <br /> sleeping rooms upstairs, five sleeping rooms on the main floor and four sleeping <br /> rooms in the basement. A sleeping room in the living room blocked entrance into 1 <br /> the residential structure through the front door. Officer Cunningham observed <br /> rooms labeled 1 — 5 on the upper floor and 6 - 10 on the main floor. To gain access <br /> of the sleeping rooms in the residential structure and notify occupants of an <br /> inspection, all parties agreed to resume the inspection on August 11, 2016. On August 11, 2016, Ted de Budden, a City of Everett Building Division Inspector, <br /> Steve Ingalsbe of the City of Everett Planning Department and Officer Cunningham <br /> met with Mr. Lapinski Jr. on site to conduct an inspection of the residential structure. <br /> The following conditions were observed and photographed: <br /> a. The original single family structure with 4 bedrooms, 2 bathrooms and one <br /> kitchen had been altered to include 14 bedrooms, 3 bathrooms and two <br /> kitchens. t <br /> b. Rooms #6, #7, #8, #10 and #14 lacked required 7 foot width for a habitable <br /> space. <br /> c. Room #1 lacked required 7 foot ceiling height for a habitable space. <br /> d. Several of the sleeping rooms lacked proper egress windows. <br /> e. Smoke alarms were missing in several locations throughout the residential <br /> structure. <br /> f. A basement access ramp lacked a required handrail. <br /> g. The alterations were completed without required City permits or inspections <br /> which rendered the structure as dangerous and unlawful. <br /> The basement was vacant at the time of the inspection. Upon research of City <br /> records, Officer Cunningham determined that the Respondent had not applied for <br /> nor obtained required City permits for alterations to the residential structure on the <br /> property.
