A <br /> 6 <br /> i <br /> 2. The fourteen unpermitted sleeping rooms in the residential structure do not meet <br /> the minimum room dimensions and ceiling heights, and several sleeping rooms do <br /> not provide the required egress window per City ordinance, rendering the structure <br /> unsafe and unlawful as defined by IPMC 108.1.1 and IPMC 108.1.4 and in violation <br /> of IPMC 106.1. The Respondents violated said City ordinances. <br /> i <br /> 3. More than 8 unrelated occupants of a single family residence is a violation of EMC <br /> 19.41.030. The Respondents violated said City ordinance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondents were in violation of IRC R105.1, IPMC 106.1 and <br /> EMC 19.41.030 and are hereby ordered to: I <br /> i <br /> 1. The Respondents must abate all violations of IRC R105.1, IPMC 106.1 and EMC <br /> 19.41.030 on property located 2201 Highland Avenue, Everett, Washington. <br /> 2. All abatement of the violations on said property must be completed by November <br /> 11, 2016, unless otherwise stated. The abatement shall include: ! <br /> a. The Respondents shall return occupancy and use of the residential structure on <br /> the property to that of a single family. <br /> 4 <br /> b. The Respondents shall have the electrical system of the residential structure on <br /> the property inspected by a licensed electrical contractor and submit a report of <br /> the condition of the electrical system by November 21, 2016 to the City of <br /> Everett Building Division. <br /> c. The Respondents shall apply for all of the necessary and required permits to <br /> bring the structure and use of the structure on the property into compliance with <br /> the EMC. The Respondents shall conduct and complete all of the required <br /> work and have the work inspected and approved by the City of Everett Building <br /> Division within 180 days from the date of the hearing or by May 17, 2017. Any <br /> violations not listed in this Order are subject to standard enforcement processes <br /> and procedures. <br /> g <br /> d. The City of Everett Building Division shall designate which rooms can be used <br /> and occupied consistent with this decision. <br /> I <br /> 3. The Respondents shall be fined $500.00 for each violation of IRC R105.1, IPMC { <br /> 106.1 and EMC 19.41.03 for a total fine of$1500.00. <br /> 4. The Respondents shall not violate any ordinance set forth in EMC §1.20.020 or any g <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br />
