S <br /> material testing lab; inspectors; and other City employees when in the opinion of the Engineer, <br /> such work necessitates their presence. <br /> 1-08.1 Subcontracting <br /> Delete the eighth paragraph in 1-08.1 and substitute the following: <br /> On all projects funded with City funds only, the Contractor shall certify to the actual amounts <br /> 1 paid Disadvantaged, Minority, or Women's Business Enterprise firms that were used as <br /> subcontractors, lower tier subcontractors, manufacturers, regular dealers, or service providers <br /> on the Contract. This certification shall be submitted to the Engineer on WSDOT form 140-542 <br /> within 20-calendar days after physical completion of the Contract. <br /> Supplement 1-08.1 by adding the following: <br /> The Contract Documents shall apply to Subcontractors and suppliers as if each had signed the <br /> Contract with the City. Contractor shall include the provisions of these Contract Documents or <br /> a"flow down"clause in each contract with Subcontractors and suppliers. <br /> The City will not approve a Subcontractor that is also providing services to the City on the <br /> same project. <br /> No Subcontractor or lower tier subcontractor will be permitted to perform Work under the <br /> Contract until the following documents have been completed and submitted to the Engineer: <br /> 1. Request to Sublet Work(Form 421-012),and <br /> 2. Contractor and Subcontractor or Lower Tier Subcontractor Certification for Federal- <br /> aid Projects(Form 420-004). <br /> The Contractor's records pertaining to the requirements of this Special Provision shall be open <br /> to inspection or audit by representatives of the City during the life of the Contract and for a <br /> period of not less than three years after the date of acceptance of the Contract. The Contractor <br /> shall retain these records for that period. The Contractor shall also guarantee that these records <br /> of all Subcontractors and lower tier subcontractors shall be available and open to similar <br /> inspection or audit for the same time period. <br /> Contractor shall not sublet to a single Subcontractor more than one-half of the Project.The City <br /> may refuse to approve any subcontract for any reason. Subcontractors will be considered agents <br /> of the Contractor and their work shall be subject to the provisions of the Contract.References in <br /> the Contract Documents to actions required of Subcontractors, manufacturers, suppliers, or any <br /> person other than the Contractor, the City or the City's Representative shall be interpreted as <br /> requiring that the Contractor shall require such Subcontractor, manufacturer, supplier or person <br /> to perform the specified action. <br /> 1-08.3 Progress Schedule <br /> 1-08.3(1) General Requirements <br /> Delete 1-08.3(1)and substitute the following: <br /> 1-08.3(1) General <br /> (******) <br /> Because time is of the essence, diligent and expeditious progress and completion of the Work <br /> by the Contract Completion Date is required of the Contractor. The purposes of the schedules and reports include: <br /> 1. Ensuring adequate planning and execution of the Work by the Contractor. <br /> 2.
