Sections and subsections in the Special Provisions labeled under the headers with(******) indicate I <br /> City of Everett Provisions. <br /> 1-01 DEFINITIONS AND TERMS <br /> 1-01.3 Definitions <br /> Section 1-01.3 is amended by adding the following: I <br /> All references in the Standard Specifications to the terms "State," "Department of <br /> Transportation,""Washington State Transportation Commission,""Commission,""Secretary of <br /> Transportation," "Secretary," "Headquarters," and "State Treasurer," shall be revised to read <br /> "City." <br /> All references to the terms"State"or"state" shall be revised to read"City"unless the reference <br /> is to an administrative agency of the State of Washington, a State statute or regulation, or the <br /> context reasonably indicates otherwise. <br /> All references to "State Materials Laboratory" shall be revised to read "City designated <br /> location." <br /> Additive: A supplemental unit of work or group of bid items, identified separately in the <br /> Proposal,that may,at the discretion of the City,be awarded in addition to the base Bid. <br /> Alternative or Alternate: One of two or more units of Work or groups of bid items, identified <br /> separately in the Proposal, from which the City may make a choice between different methods <br /> or material of construction for performing the same Work. <br /> Award Date: The date of the formal action by the Everett City Council to accept the lowest <br /> responsible and responsive Bidder for the Work. <br /> Bid Documents: The component parts of the proposed Contract which may include, but are <br /> not limited to, the Proposal Form, the proposed Contract Provisions, the proposed Contract <br /> Plans, and Addenda. (This definition replaces the definition in WSDOT 1-01.3 for Bid <br /> Documents.) <br /> Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> Business Day: A business day is any day from Monday through Friday except holidays as <br /> listed in 1-08.5. <br /> Change Order: Reference to Change Order shall include all rights of the City and Contractor <br /> under 1-04.4 CHANGES. Agreed Change Orders shall be in the form attached as Exhibit 1. <br /> Unilateral Change Orders shall be in the form attached as Exhibit 2. <br /> Completion Date: Date on which Project is ready for Final Acceptance. All physical work, <br /> including Punch List, is complete and Contractor has completed and fulfilled all contractual <br /> obligations except any maintenance of landscaping. Contractual obligations that must be <br /> fulfilled prior to achievement of the Completion Date include, but are not limited to, the <br /> Contractor's furnishing all documentation, including correct, complete and accurate as-built or <br /> record drawings and operation and maintenance manuals and transfer of warranties. (This <br /> definition replaces the definition in WSDOT 1-01.3 for Completion Dates.) <br /> Contract: Written agreement signed between the Owner and Contractor and includes Division <br /> C — CONTRACT, Division P — PROPOSAL, Division B — BID ITEM DESCRIPTIONS, <br /> Special Provisions, Contract Plans, Standard Specifications and amendments, Standard Plans in <br /> effect as of the date Bids are opened, Addenda, supplemental agreements, change orders, <br /> certifications and affidavits required by this Contract and by law, and Federal requirements that <br /> apply to this Contract and Project.
