Bid bonds shall contain the following: <br /> 1. City-assigned number for the Project; <br /> 2. Name of the Project; <br /> 3. The City of Everett named as obligee; <br /> 4. The amount of the bid bond stated either as a dollar figure or as a percentage that <br /> ' represents five percent of the maximum bid amount that could be awarded; <br /> 5. Signature of the Bidder's officer empowered to sign official statements. The <br /> signature of the person authorized to submit the Bid should agree with the <br /> signature on the bond, and the title of the person must accompany the said <br /> signature; <br /> 6. The signature of the surety's officer empowered to sign the bond and the power <br /> ' of attorney. <br /> Bidder shall use the bond form included in the Bid Documents. <br /> 1-02.8 Noncollusion Declaration and Lobbying Certification <br /> 1-02.8(1) Noncollusion Declaration <br /> Supplement 1-02.8(1)by adding the following: <br /> The City has determined every Bidder must submit a Non-Collusion Affidavit for every <br /> Project. Accordingly, the Bidder shall submit a "Non-Collusion Affidavit," contained in <br /> the Contract Documents, as part of the Proposal package. If the City has reason to believe <br /> that collusion exists among Bidders, the City will reject the Bids of the known <br /> ' participants in such collusion and may, at its option, require that all Bidders certify under <br /> penalty of perjury,that no collusion has occurred or exists. <br /> 1-02.9 Delivery of Proposal <br /> ' Delete all of 1-02.9 and substitute the following: <br /> Bidder shall submit Bidder's Proposal in a sealed opaque envelope that clearly and legibly <br /> notes the Project Name, the time and date of the bid opening, and the Bidder's name and <br /> ' address on the outside of the envelope. <br /> The City will not open or consider any Proposal or any supplement to a Proposal that is <br /> received after the time specified for receipt of Proposals, or received in a location other than <br /> that specified for receipt of Proposals. <br /> 1-02.10 Withdrawaling,Revising, or Supplementing Proposal <br /> Delete 1-02.10 and substitute with the following: <br /> After submitting a physical Bid Proposal to the City, the Bidder may withdraw, revise, or <br /> supplement it if: <br /> 1. The Bidder submits a written request signed by an authorized person,and <br /> 2. The City receives the request before the time set for receipt of Proposals. <br /> The original physical Bid Proposal may be supplemented, or revised and resubmitted as the <br /> official Bid Proposal if the City receives it before the time set for receipt of Proposals. Email, <br /> fax or telephone requests to withdraw,revise, or supplement a Proposal are not acceptable. <br /> Resubmitted Proposals shall be in full compliance with the bidding requirements.
