I <br /> I Contractor shall employ and keep on site on a full time basis personnel experienced in the <br /> management of construction of projects of this size and type. These shall include, but not be <br /> limited to, a project manager and superintendent.Neither the Contractor's project manager nor <br /> the superintendent shall have supervisory responsibility for other projects for the Contractor <br /> while assigned to this Project. Contractor shall employ and assign such additional, full time <br /> office, support and engineering personnel to support the project manager and superintendent <br /> 1 and allow timely completion of the Project. The project manager and superintendent shall be <br /> approved by the City, and such approval shall not be unreasonably withheld. Contractor shall <br /> submit personnel qualifications within seven(7)days of Contractor's execution of the Contract. <br /> Basis for disapproval include, but are not limited to, lack of sufficient experience managing the <br /> I construction of similar type or size projects or relationships on other projects unsatisfactory to <br /> the City or, if the Project is subject to supplemental bidder responsibility criteria and such <br /> criteria contain personnel qualifications,the personnel differ from those named by Bidder in its <br /> pre-Award supplemental bidder responsibility criteria submittals. City may require removal and <br /> replacement of Contractor's supervisory staff who are disruptive or who appear to lack <br /> sufficient competence to complete the Project successfully. <br /> I1-05.18(2) Construction Procedures <br /> The Contractor shall supervise and direct the Work and determine the means, methods, <br /> I techniques, sequences and procedures of construction,except in those instances where the City, <br /> to define the quality of an item of Work, specifies in the Contract a means, method, technique, <br /> sequence or procedure for construction of that item of Work.The Contractor shall execute Work <br /> in conformity with the standard practice of the trade. <br /> I1-05.18(3) Responsibilities <br /> 1-05.18(3)A Manufacturers and Suppliers <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br /> Il manufacturers, Suppliers and their employees. <br /> 1-05.18(3)B Contractor's Employees <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of its <br /> employees. Workers shall have sufficient knowledge, skill and experience to perform <br /> properly the Work assigned to them. <br /> 1-05.18(3)C Payment for Labor and Materials <br /> I <br /> The Contractor shall pay and require its Subcontractors to pay any and all accounts for <br /> labor including Worker's Compensation premiums, State Unemployment and Federal <br /> Social Security payments and other wage and salary deductions required by law. The <br /> Contractor also shall pay and cause its Subcontractors to pay any and all accounts for <br /> services, equipment, and materials used by him and its Subcontractors during the <br /> performance of Work under this Contract.The Contractor shall pay such accounts as they <br /> become due and payable. If requested by the City, the Contractor shall promptly furnish <br /> proof of payment of such accounts to the City. <br /> I 1-05.18(3)D Attention to Work <br /> The Contractor, either in person or acting through its representative, shall give personal <br /> attention to and shall manage the Work so that it shall be prosecuted faithfully and <br /> completed under the Project schedule. When its representative is not personally present at <br /> the Project site, its designated alternate shall be available and shall have the authority to <br /> act in matters relating to this Contract. <br /> i Where detailed construction requirements are not set forth in the Standard Specifications <br /> or these Special Provisions, the Contractor shall perform the Work of a quality <br /> comparable to the workmanship specified for other parts of the Work, from firms having <br /> established good reputations for similar Work, or by following industry standard <br /> 11 <br /> HAYES STREET REGULATOR February, 2017 <br /> I AND CSO CONTROLS (SRO1, SRO2,AND SRO3) <br /> WO No—UP3398-31 SP - 77 <br />
