<br /> practices. The Contractor shall perform all Work in compliance with and conforming toIF
<br /> applicable building codes in effect at the time the Work is being performed.
<br /> 1-05.18(3)E Safety
<br /> The Contractor alone shall be responsible for safety on the job site, including, but not
<br /> limited to, the safety of its and its Subcontractor's employees. The Contractor shall
<br /> maintain the Project site and perform the Work in a manner that meets the City's
<br /> responsibility under statutory and common law for the provision of a safe place to work.
<br /> 1-05.18(3)F Threats,Intimidation and Harassment Forbidden
<br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors'
<br /> employees, or any other agents to threaten bodily injury or property damage, to
<br /> intimidate or attempt to intimidate any person, or to assault or physically harass any
<br /> person. Forbidden conduct includes, but is not limited to, threatening, appearing, or
<br /> actually doing any of the following: pushing, shoving, striking, physically blocking a
<br /> person or a person's vehicle, vandalism, malicious mischief, or any other act that a
<br /> reasonable person would understand be intended to intimidate, cause personal injury, or
<br /> cause property damage. Contractor shall remove from the job site any person reasonably
<br /> under its control or direction who the Contractor or City reasonably believes violated this
<br /> section. The lack of a request from the City or City's Representative to the Contractor to
<br /> remove someone from the job site does not relieve the Contractor from its obligation to
<br /> remove someone.
<br /> 1-05.18(3)G Weapons Forbidden
<br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors'
<br /> 111
<br /> employees, or any other agents or representatives to carry or possess, openly or
<br /> concealed, explosives or weapons on the job site, except: (a) such explosives as are
<br /> reasonably required for performance of the Work, such as those necessary for blasting or
<br /> demolition work called for by the Contract Documents or (b) commissioned law
<br /> enforcement officers or security personnel under authority of their commission. A
<br /> weapon is any object, instrument or chemical that is (1) designed in such a manner to
<br /> inflict harm or injury to another person; or (2) any item used in a manner threatening
<br /> harm or injury to another person. Weapons include, but are not limited to, firearms,
<br /> dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or
<br /> other weapons. Further, weapons should include those described in EMC Chapter 10.78.
<br /> Possession of mace, pepper spray or the like for defensive purposes is not a violation of
<br /> this policy. Contractor shall remove from the job site any person reasonably under its
<br /> control or direction who the Contractor or City reasonably believes violated this section.
<br /> The lack of a request from the City or City's Representative to the Contractor to remove
<br /> someone from the job site does not relieve the Contractor from its obligation to remove
<br /> someone.
<br /> 1-05.18(3)H Safety Standards
<br /> The Contractor shall comply with Section 107 of the Contract Work Hours and Safety
<br /> Standards Act(40 U.S.C. 327-330) as supplemented by Department of Labor Regulations
<br /> (29 CFR, Part 5). Under this Section, the Contractor shall not require any laborer or
<br /> mechanic to work in surroundings or under working conditions that are unsanitary,
<br /> hazardous, or dangerous to its health and safety as determined under construction, safety,
<br /> and health standards promulgated by the Secretary of Labor. These requirements do not
<br /> apply to the purchase of supplies or materials or articles ordinarily available on the open
<br /> market,or contracts for transportation or transmission of intelligence.
<br /> 1-05.18(3)I Public Safety and Convenience
<br /> The Contractor shall conduct its work so as to ensure the least possible obstruction to
<br /> traffic and inconvenience to the general public, business, organizations and residents in
