ORDINANCE NO. 2915-06 <br />AN ORDINANCE providing for the vacation of a portion of the alley lying South of 33rd Street <br />between Norton and Grand Avenues in Block 787, Plat of Everett, Division `H'., according to the <br />plat thereof, recorded in Volume 4 of Plats, Page 50, records of Snohomish County, Washington; <br />WHEREAS, the City Council of the City of Everett, did by Resolution No. 5713 duly <br />adopt and fix the 25th day of January, 2006 at 8:30A.M., as the date of public hearing; and <br />WHEREAS, due and legal notice of the time and place of said hearing and determination <br />of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br />WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br />and <br />WHEREAS, it now appears to the City Council of the City of Everett that the said rights <br />of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br />ordinance: <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: <br />That the following described rights-of-way: <br />All that portion of the alley lying South of 33rd Street between Norton and Grand Avenues in <br />Block 787, Plat of Everett, Division `H'., according to the plat thereof, recorded in Volume 4 of <br />Plats, Page 50, records of Snohomish County, Washington; described as follows: <br />THAT PART OF THE FOLLOWING DESCRIBED STRIP OF LAND FOR RIGHT OF <br />WAY LYING WITHIN LOTS 17,18,19 AND 20 IN BLOCK 787, PLAT OF EVERETT DIVISION <br />"H" TO WIT, <br />A STRIP OF LAND 12 FEET WIDE BEING 4.5 FEET ON THE EAST SIDE AND 7.5 <br />FEET ON THE WEST SIDE OF THE FOLLOWING DESCRIBED CENTERLINE: <br />BEGINNING AT THE INTERSECTION OF THE WEST MARGIN OF GRAND <br />AVENUE AND THE CENTER LINE OF 34TH STREET; THENCE WEST ALONG THE <br />CENTERLINE OF 34TH STREET A DISTANCE OF 18.87 FEET; THENCE ON A CURVE TO <br />THE RIGHT HAVING A RADIUS OF 136 FEET A DISTANCE OF 71.21 FEET; THENCE ON A <br />CURVE TO THE RIGHT HAVING A RADIUS OF 50 FEET A DISTANCE OF 44.07 FEET; <br />THENCE ON A TANGENT TO A POINT 10 FEET WEST OF THE NORTHWEST CORNER <br />OF LOT 21, BLOCK 787, PLAT OF EVERETT, DIVISION 'H <br />ALSO, THAT PORTION OF VACATED 34TH STREET IN BLOCK 787, PLAT OF <br />EVERETT, DIVISION 'H', LYING WITHIN A STRIP OF LAND, BEING THE FOLLOWING <br />DESCRIBED STRIP OF LAND 12 FEET WIDE, BEING 4.5 FEET ON THE NORTH AND EAST <br />
