SIDE AND 7.5 FEET ON THE SOUTH AND WEST SIDE OF THE FOLLOWING DESCRIBED <br />CENTERLINE: <br />BEGINNING AT THE INTERSECTION OF THE WEST MARGIN OF GRAND <br />AVENUE AND THE CENTERLINE OF 34TH STREET; THENCE WEST ALONG SAID <br />CENTERLINE OF 34TH STREET A DISTANCE OF 18.87 FEET, THENCE ON A CURVE TO <br />THE RIGHT HAVING A RADIUS OF 136 FEET, A DISTANCE OF 71.21 FEET; THENCE ON A <br />CURVE TO THE RIGHT HAVING A RADIUS OF 50 FEET, A DISTANCE OF 30 FEET, MORE <br />OR LESS, TO THE NORTH MARGIN OF 34TH STREET. <br />ALSO, THAT PORTION OF THE VACATED ALLEY IN BLOCK 787, PLAT OF <br />EVERETT, DIVISION "H", LYING WITHIN A STRIP OF LAND, BEING THE FOLLOWING <br />DESCRIBED STRIP OF LAND 12 FEET WIDE, BEING 4.5 FEET ON THE EAST SIDE AND 7.5 <br />FEET ON THE WEST SIDE OF THE FOLLOWING DESCRIBED CENTERLINE: <br />BEGINNING AT A POINT 10 FEET WEST OF THE NORTHWEST CORNER OF LOT <br />21 OF SAID BLOCK 787; THENCE SOUTHEASTERLY AND INTERSECTING THE WEST <br />LINE OF LOT 19 OF SAID BLOCK 787 AT A POINT 10.6 FEET SOUTH OF THE <br />NORTHWEST CORNER OF SAID LOT 19. <br />SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. <br />be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. <br />Section 2: <br />That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting <br />from existing drainage patterns as established on City rights-of-way that may currently, or in the <br />future, go over, under or across the above described rights of way herein. <br />Section 3: <br />If any provision of this ordinance shall be declared unconstitutional or invalid by any court of <br />competent jurisdiction, it shall be conclusively presumed that this ordinance would have been <br />enacted without the provision so held unconstitutional or invalid and the remainder of this <br />ordinance shall not be affected as a result of said part being held unconstitutional or invalid. <br />Section 4: <br />That this ordinance shall not become effective until the owner(s) of the property abutting upon <br />the right of ways herein described have compensated the City of Everett in an amount equal to <br />one hundred percent of the current appraised value of the area herein described. The abutting <br />property owner(s) shall have ninety (90) days following passage of this ordinance to exercise this <br />vacation. Unless otherwise amendes by City Council, this ordinance shall be null and void if the <br />abutting property owner(s) fail to exercise this vacation within ninety (90) days following <br />passage of this ordinance. <br />Section 5: <br />That all moneys derived from the sale of the above-described right-of-way vacation shall be <br />deposited in the "Real Property Acquisition Fund." <br />
