Such oral agreement or conversation shall be <br /> 11 considered as unofficial information and in no way binding upon the Contracting <br /> 12 Agency, unless subsequently put in writing and signed by the Contracting <br /> 13 Agency. <br /> 14 <br /> 15 <br /> 16 <br /> 17 1-07 .GR1 <br /> 18 <br /> 19 Legal Relations and Responsibilities to the Public <br /> 20 <br /> 21 1-07.1.RTF <br /> 22 1-07.1 Laws to be Observed <br /> 23 (October 1, 2005 APWA GSP) <br /> 24 <br /> 25 Supplement this section with the following: <br /> 26 <br /> 27 In cases of conflict between different safety regulations, the more stringent <br /> 28 regulation shall apply. <br /> 29 <br /> 30 The Washington State Department of Labor and Industries shall be the sole and <br /> 31 paramount administrative agency responsible for the administration of the <br /> 32 provisions of the Washington Industrial Safety and Health Act of 1973 (WISHA). <br /> 33 <br /> 34 The Contractor shall maintain at the project site office, or other well known place <br /> 35 at the project site, all articles necessary for providing first aid to the injured. The <br /> 36 Contractor shall establish, publish, and make known to all employees, <br /> 37 procedures for ensuring immediate removal to a hospital, or doctor's care, <br /> 38 persons, including employees, who may have been injured on the project site. <br /> 39 Employees should not be permitted to work on the project site before the <br /> 40 Contractor has established and made known procedures for removal of injured <br /> 41 persons to a hospital or a doctor's care. <br /> 42 <br /> 43 The Contractor shall have sole responsibility for the safety, efficiency, and <br /> 44 adequacy of the Contractor's plant, appliances, and methods, and for any <br /> 45 damage or injury resulting from their failure, or improper maintenance, use, or <br /> 46 operation. The Contractor shall be solely and completely responsible for the <br /> 47 conditions of the project site, including safety for all persons and property in the <br /> 48 performance of the work. This requirement shall apply continuously, and not be <br /> 49 limited to normal working hours.
