Findings & Decision
September 22, 1994
Page 2
4. The owners requested a 90 day, which was amended to 180 days at the hearing,
extension of the deadline.
5. Appellant based the appeal on the status of the property which is for sale, and
the desire to retain the nonconforming status of the structure relative to size and
proximity to property lines.
6. Appellant further stated that a reduction in the property's off-street parking
capacity serves to force additional vehicles on to the street.
7. The nonconforming status of the structure is not an issue with the neighborhood,
as represented at the hearing.
Conclusions
1. The building is defined as dangerous and a public nuisance by the Uniform
Code for the Abatement of Dangerous Buildings.
2. The condition of the structure is deteriorated to a level that makes repair
impractical.
3. The requested extension further extends a long history of building abuse and
vandalism.
Decision
Based upon the Findings and Conclusions, the testimony and evidence submitted and
the impressions of the Board, it is hereby ordered that the appeal of Appellant is
denied.
