PLANNING DIRECTOR DETERMINATION
Review Process II #00-023
INTRODUCTION: The City of Everett Planning Dep7-tment received an application from
Marilyn Ceresa, 3331 Hoyt Ave, Everett, WA 98201 , for a 13'-6" by 19' addition to the rear of
her existing single family residence and an 8' by 11' shed. The existing residence is located
only one foot from the south s:de property line along 34'h Street SE and as close as only 3 feet
from the north side property line. The new addition will have the same setbacks as the house
along the south side property line and a 4-foot setback from the north side property line. The
shed will meet all setback requirements except for a setback of 8'-7" from the south side
property line. The existing residence was originally constructed in 1905 according to the
Snohomish County Assessor's records and has been certified as a legal non-conforming
structure (NC13#004026). Section 38.040 allows for tie Planning Director to permit the
expansion of a structure which does not meet required setbacks or height, provided that the
expansion does not make the setback or height more nonconforming: that the expansion
complies with all other requirements of the zoning code ordinance; and that the nonconformity
has been certified by the Planning Department,
FINDINGS: The property is located in the R-5, Multiple Family Residential Zone. The typical
required setbacks from the interior side property line is 5 feet and 10 feet from the street side
property line. It was originally constructed in 1905
according to the Snohomish County Assessor's records. The zoning code requirements for
buildir:g setbacks for structures frcm side property lines became effective December 1 , 1956.
DECISION: The Planning Director has determined to allow for the proposal with the following
conditions:
1 . All necessary building permits are to be obtained from the City of Everett's Building
Department.
Right to Appeal: The applicant or owner of property located adjacent to the subject property
or any property owner who deems himself aggrieved and will thereby suffer a direct impact
from the proposal may appeal the Planning Director's determination as to whether or not the
proposal should be permitted. Any such appeal must be filed within fourteer. (14) calendar
days of the date specified below. Appeal forms are available from the Planning Department
and must be submitted along with the required filing fee. For more information concerning
this determination, contact Michael Palacios at the Planning Department (tel. 257-8731).
Signed: _ ate: December 4, 2000
Paul A.
