°1114"44iiiiiWdigt <br /> ORDINANCE No. 3552-17 <br /> AN ORDINANCE Relating to Patronizing a Prostitute,Amending Section 3 of Ordinance <br /> No. 1567-89, as Amended (Chapter 10.24.140 EMC). <br /> Whereas, the City of Everett has the power to provide for the punishment of all practices <br /> dangerous to public health or safety and to provide for the punishment of all persons charged <br /> with violating any city ordinances; and <br /> Whereas, State law relating to the crime Patronizing a Prostitute (Chapter 10.24.140 <br /> EMC) will be amended contingent upon the Governor signing SHB 1184. SHB 1184 clarifies <br /> that the location in which the crime Patronizing a Prostitute is subject to prosecution is both the <br /> location from which the communication is sent as well as the location in which the <br /> communication is received; and <br /> Whereas, the Everett City Council deems it appropriate for the crime Patronizing a <br /> Prostitute (Chapter 10.24.140 EMC) to be amended, with an effective date only upon SHB 1184 <br /> coming into effect, in light of changes to State law; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 3 of Ordinance No. 1567-89 (EMC 10.24.140), is hereby amended as <br /> follows: <br /> Patronizing a prostitute. <br /> 1. A person is guilty of patronizing a prostitute if: <br /> (a) pursuant to a prior understanding, he or she pays a fee to another person as <br /> compensation for such person or a third person having engaged in sexual conduct with <br /> him or her; or <br /> (b) he or she pays or agrees to pay a fee to another person pursuant to an understanding <br /> that in return therefor such person will engage in sexual conduct with him or her; or <br /> (c) he or she solicits or requests another person to engage in sexual conduct with him or <br /> her in return for a fee <br /> 2. Patronizing a prostitute is a misdemeanor. <br /> Be and the same is hereby amended to read as follows: <br /> Patronizing a prostitute. <br /> A. A person is guilty of patronizing a prostitute if: <br />
