1. pursuant to a prior understanding, he or she pays a fee to another person as compensation for <br /> such person or a third person having engaged in sexual conduct with him or her; or <br /> 2.he or she pays or agrees to pay a fee to another person pursuant to an understanding that in return <br /> therefor such person will engage in sexual conduct with him or her; or <br /> 3.he or she solicits or requests another person to engage in sexual conduct with him or her in return <br /> for a fee <br /> B. The crime of patronizing a prostitute may be committed in more than one location. The crime is <br /> deemed to have been committed in any location in which the defendant commits any act under EMC <br /> 10.24.140(A) that constitutes part of the crime. A person who sends a communication to patronize a <br /> prostitute is considered to have committed the crime at the place from which the contact was made <br /> pursuant to EMC 10.24.140(A)or where the communication is received. <br /> C. Patronizing a prostitute is a misdemeanor. <br /> Section 2. Effective date <br /> This Ordinance is based upon changes in State law which are not in effect until SHB 1184 is signed <br /> by the Governor. This Ordinance shall become effective at such time as said State law becomes <br /> effective but no sooner than fifteen days after this Ordinance is approved by the City Council and <br /> signed by the Mayor. <br /> Section 3. Severability <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or its <br /> application to any person or situation, be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this Ordinance or its application <br /> to any other person or situation. The City Council of the City of Everett hereby declares that it <br /> would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or more sections, subsections, clauses,phrases <br /> or portions be declared invalid or unconstitutional. <br /> Section 4. General Duty <br /> It is expressly the purpose of this Ordinance to provide for and promote the health, safety and <br /> welfare of the general public and not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially protected or benefited by the terms of <br /> this Ordinance. It is the specific intent of this Ordinance that no provision or any term used in this <br /> Ordinance is intended to impose any duty whatsoever upon the City or any of its officers or <br /> employees. Nothing contained in this Ordinance is intended nor shall be construed to create or <br /> form the basis of any liability on the part of the City, or its officers, employees or agents, for any <br />
