PLANNING DIRECTOR DECISION
ACCESSORY DWELLING UNIT
REVIEW PROCESS 1 #02-006
The City of Everett Planning Director grants approval of a request by Dan Johnston at 2215
Main Street to construct an attached garage with an accessory dwelling unit with the
following conditions:
1. The applicant must comply with all 13 criteria of Section 39.020.D of the City's
Zoning Code (as summarized below), as well as all other provisions of the City's
Zoning Code and all other applicable City codes.
2. No direct access shall be permitted from the accessory dwelling unit into the
storage/office area constructed over the garage. This area shall not be used as
additional living space for the accessory dwelling unit. Any use of this space for
such purposes would be a violation of criteria # 4 of this approval.
Accessory dwelling units are permitted subject to approval by the Planning Director using Review
Process I. The Planning Director, using Review Process I, is authorized to "...approve,
disapprove, or approve with conditions the use proposed by the applicant." (Subsection 41.100.13)
If no appeal is filed in response to the Planning Director's determination, the decision will be
considered final. If an appeal of the decision is filed, such an appeal must be submitted to the
City's Hearing Examiner.
Subsection 39.020.D of the Zoning Code establishes 13 criteria by which such proposals must be
evaluated. These are as follows:
1. An accessory dwelling unit may be established in an existing single family dwelling
unit, on lots containing at least 5,000 square feet, by one or a combination of the
following:
a. alteration of the interior space of the dwelling,
b. conversion of an attic, basement, attached garage, or other previously
uninhabited portion of a dwelling or attached accessory structure; or
c. addition of attached living area onto the existing dwelling.
The subject lot is approximately 7,200 square feet in area. The applicant will construct a
new 32' 6" x 42' garage with an accessory dwelling unit above. The garage will be attached
with a new 2-story utility room/ office addition.
2. Each single family dwelling on a legal building lot shall not have more than one
accessory dwelling unit. No accessory dwelling may be located in any detached
accessory structure.
The proposed action is for one accessory dwelling unit on site. The proposed garage and
accessory dwelling unit will be attached to the existing single family residence on site.
3. One of the dwelling units shall be occupied by one or more owners of the property as
the owner's permanent and principal residence.
The owner of the property has submitted a certificate of ownership which states that one of
the units will be owner occupied. This certificate will need to be renewed with the City each
year to insure that one unit remains owner occupied.
